COMMISSIONER OF WEALTH TAX vs. CENTRAL NOST TRUST
What did the High Court hold?
The High Court of Gujarat, in its oral judgment, answered the referred question in the affirmative, in favour of the assessee and against the Revenue. The Court relied on its previous decision in Wealth Tax Reference No. 47 of 1993. The reasoning was that while a representative assessee holding assets for beneficiaries with indeterminate shares is assessed as an individual, Section 21(4) of the Wealth Tax Act mandates that such assessment should be in the same manner and to the same extent as an individual. Therefore, if an individual is not liable to pay wealth tax or it is not recoverable from them, it cannot be recovered from the representative assessee to that extent. The Court found it fallacious to assume that the Legislature intended to remove the exemption limit for such cases solely due to the prescription of higher rates by subsequent amendments. The reference was disposed of accordingly.
What were the facts?
This case involves a reference to the High Court of Gujarat by the Income-tax Appellate Tribunal, Ahmedabad, concerning Wealth Tax Reference No. 25 of 1997. The assessee is Central Nost Trust, and the petitioner is the Commissioner of Wealth Tax. The assessment year(s) are not explicitly stated. The order under challenge is the decision of the Income-tax Appellate Tribunal. The dispute pertains to the application of Section 21(4) of the Wealth Tax Act, 1957, and the taxation of the trust at higher rates when its net wealth was below the exemption limit. The procedural history involves the Tribunal referring a question of law to the High Court for its opinion.
What were the issues?
1. Whether the Appellate Tribunal is right in law and on facts in holding that as the net wealth of the assessee was below the exemption limit, the WTO was not justified in applying the provisions of section 21(4) of the W.T. Act and taxing the trust at the higher of the two rates prescribed under section 21(4) of the W.T. Act? Assessee's Contention: The assessee, through the Tribunal's decision, argued that since the net wealth was below the exemption limit, the Wealth Tax Officer (WTO) was not justified in applying Section 21(4) of the Wealth Tax Act and taxing the trust at the higher rates. Revenue's Contention: The Revenue, represented by the Commissioner of Wealth Tax, presumably contested the Tribunal's finding, as the question is referred for the High Court's opinion. The judgment does not explicitly record the Revenue's arguments but implies disagreement with the Tribunal's conclusion.

ORAL JUDGEMENT (Per R.K.Abichandani,J)
The Income-tax Appellate Tribunal, Ahmedabad has referred the following question for the opinion of this Court under section 27(1) of the Wealth Tax Act, 1957.
"Whether the Appellate Tribunal is right in law and on facts in holding that as the net wealth of the assessee was below the exemption limit the W.T.O. was not justified in applying the provisions of section 21(4) of the W.T.Act and taxing the trust at higher of the two rates prescribed under section 21(4) of the W.T. Act?"
Similar question had come up for consideration by this Court in Wealth Tax Reference No. 47 of 1993 and by the decision dated 29.1.1998, it was held that though a representative assessee who holds the assets on behalf of the beneficiaries, whose shares are indeterminate or unknown, is required to be assessed as an individual, the provisions of section 21(4) of the Wealth Tax Act made it clear that, that should be done in the same manner and to the same extent as the levy and recovery could be made from an individual. It was held that if an individual was not liable to pay wealth tax and the wealth tax was not recoverable from him, then to that extent, it could also not be recovered from such representative assessee who was required to be assessed as an individual. It was further held that it would be fallacious to say that the Legislature intended to take away the exemption limit which was applicable in such cases merely because higher rate came to be prescribed by the subsequent amendments. For this and other reasons, given for the said decision in Wealth Tax Reference No.47 of 1993, we answer the question referred to this Court in the affirmative in favour of the assessee and against the Revenue. The Reference stands disposed of accordingly with no order as to costs. ... ***darji
