What did the High Court hold?

The High Court held that the issue concerning the deletion of disallowance under Section 14A of the Act read with Rule 8D of the Income Tax Rules is no longer res integra (a matter not yet decided). The Tribunal had relied on the High Court's own decision in Commissioner of Income Tax Vs. Cortech Energy Private Ltd., reported in 372 ITR 97. This precedent established that the disallowance of expenditure under Section 14A read with Rule 8D cannot exceed the amount of exempt income. Therefore, following its own established legal position, the High Court found no error in the Tribunal's order. The appeal filed by the Revenue was dismissed.

What were the facts?

This is a tax appeal filed by the Principal Commissioner of Income Tax (Revenue) against an order of the Income Tax Appellate Tribunal (ITAT), Ahmedabad Bench, dated June 1, 2020. The appeal pertains to Assessment Year 2014-15. The dispute revolves around the deletion of a disallowance of Rs. 1,63,29,319/- made by the Assessing Officer under Section 14A of the Income Tax Act, 1961, read with Rule 8D of the Income Tax Rules. The ITAT's order, which deleted this disallowance, is the subject of the present appeal before the High Court.

What were the issues?

1. Whether the Appellate Tribunal has erred in law and on facts in deleting the disallowance of Rs.1,63,29,319/- made under Section 14A of the Act read with Rule 8D of the Income Tax Rules, without considering that expenses relatable to earning exempt income cannot be allowed? Assessee's Contention: The judgment does not record any specific contentions made by the assessee before the High Court. However, the ITAT's decision, which is being challenged, relied on the High Court's own previous decision in Commissioner of Income Tax Vs. Cortech Energy Private Ltd. (372 ITR 97), suggesting the assessee likely argued that the disallowance cannot exceed the exempt income. Revenue's Contention: The Revenue argued that the Appellate Tribunal erred in deleting the disallowance made under Section 14A read with Rule 8D, asserting that expenses related to earning exempt income should not be allowed.
