PRATHAMIKA KRUSHI PATTINA SAHAKARA SANGHA NIYAMITHA BESAGARAHALLI,BESAGARAHALLI AND POST MADDUR TQ MANDYA DIST vs. THE INCOME TAX OFFICER WARD 1 & TPS MANDYA, MANDYA
What did the Tribunal hold?
The Tribunal held that the appeal of the assessee is dismissed. The core issue revolved around the allowability of deduction under Section 80P when the return of income was filed belatedly. The Tribunal referred to Section 80AC of the Income Tax Act, as amended by the Finance Act, 2018, which clearly stipulates that no deduction under Part C of Chapter VI-A of the Act shall be allowed unless the return of income is furnished on or before the due date specified under Section 139(1). The Tribunal noted that the assessee had not filed its return within the due date for the Assessment Year 2019-2020 and had filed it belatedly. The Tribunal found that Section 80AC limits the allowability of deductions to returns filed within the due date and does not extend to returns filed belatedly. The Tribunal also relied on the Madras High Court's decision in AA520 Veerappampalayam Primary Agricultural Co-operative Credit Society Ltd. Vs. DCIT, which held that deductions under Part C of Chapter VI-A are admissible only if the return is filed within the prescribed due date, and no claim under these provisions would be admissible in the case of a belated return. Therefore, the Tribunal concluded that the deduction under Section 80P could not be allowed.
What were the facts?
The assessee, Prathimika Krushi Pattina Sahakara Sangha Niyamitha Besagarahalli, is a primary agricultural credit co-operative society. For Assessment Year 2019-2020, it filed its return of income on July 14, 2020, claiming a deduction of Rs. 13,10,275/- under Section 80P of the Income Tax Act. The assessee received an intimation under Section 143(1) dated September 23, 2020, wherein the Central Processing Centre (CPC) denied the claimed deduction. The assessee appealed to the CIT(A), who upheld the denial, invoking Section 80AC of the Act due to the belated filing of the return. The assessee then filed an appeal before the ITAT, Bangalore Bench, with a delay of 24 days, which was condoned.
What were the issues?
1. Whether the assessee is entitled to claim deduction under Section 80P of the Income Tax Act when the return of income was filed belatedly, i.e., after the due date specified under Section 139(1) of the Act, for the Assessment Year 2019-2020. Assessee's contention: The learned AR argued that the assessee, being situated in a rural area, was not conversant with income tax provisions and therefore could not file the return within the specified period. The assessee prayed for condonation of the delay in filing the return and for the allowance of the Section 80P deduction. Revenue's contention: The learned DR submitted that deduction under Section 80P is permissible only if the return of income is filed under Section 139(1) of the Act. Citing the amendment by the Finance Act, 2018, effective from April 1, 2018, the DR stated that no deduction under Part C of Chapter VI-A, including Section 80P, is allowed unless the return is furnished on or before the due date specified under Section 139(1). The DR relied on the decision of the Madras High Court in AA520 Veerappampalayam Primary Agricultural Co-operative Credit Society Ltd. Vs. DCIT.

Income Tax Appellate Tribunal, BANGALORE BENCHES, BANGALORE
Before: SHRI BALAKRISHNAN S & SHRI SOUNDARARAJAN K.
PER SHRI BALAKRISHNAN S, ACCOUNTANT MEMBER: This appeal is filed by the assessee against the order of Ld. CIT(A), vide DIN: ITBA/APL/S/250/2024-25/1074293473(1) dated 06-Aug-2025 for the Assessment Year 2019-2020, against the intimation passed under section 143(1) of the Act dated 23.09.2020.
At the outset, it was noticed that the appeal was filed with a delay of 24 days. On perusal of the petition filed for condonation of delay and affidavit, we find that there is sufficient cause for the assessee in filing the appeal belatedly. We therefore condone the delay and proceed to adjudicate the appeal on merits in the following paragraphs.
Briefly stated, the facts of the case are assessee a primary agricultural credit co- operative society registered under the Karnataka Co-operative Societies Act, 1959, filed its return on 14.07.2020, admitting a gross total income of Rs.16,99,289/- and has claimed deduction under section 80P of the Act amounting to Rs.13,10,275/-. The assessee received an intimation under section 143(1) of the Act dated 23.09.2020 wherein the CPC has denied the deduction claimed by the assessee under section 80P of the act.
On being aggrieved by the Order of the learned AO, assessee carried the matter before learned CIT(A). The learned CIT(A) noticed that assessee has filed return of income belatedly and thereby invoked the provisions of section 80AC of the Act and denied the deduction claimed by the assessee under section 80P of the Act thereby dismissing the appeal of the assessee.
On being aggrieved by the Order of the learned CIT(A), assessee is in appeal before us by raising the various grounds. The only issue contested by the assessee is with respect to denial of deduction under section 80P of the Act amounting to Rs.13,10,275/-. The learned AR submitted that the assessee situated in a rural area was not conversant with the provisions of income tax and hence could not file the return of income within the period specified under section 139(1) of the Act. He therefore prayed that the delay in filing the return of income shall be condoned and the deduction under section 80P of the Act claimed by the assessee be allowed.
Per contra, the learned DR filed written submissions and stated that deduction under section 80P of the Act shall be allowed only when the assessee filed the return of income under section 139(1) of the Act. The Finance Act, 2018, was amended w.e.f. 01.04.2018 and provides that no deduction under Part C of Chapter VI-A including the deduction under section 80P of the Act shall be allowed unless the return of income is 2 furnished on or before the due date specified under section 139(1) of the Act. He relied on the decision of the Hon’ble Madras High Court in AA520 Veerappampalayam Primary Agricultural Co-operative Credit Society Ltd., Vs. DCIT reported in [2022] 138 taxmann.com 571 (Mad.).
We have heard the rival contentions and perused the material available on record. Admittedly, the assessee has not filed its return of income within the due date under section 139(1) of the Act for the Assessment Year 2019-20. The assessee has filed its return of income belatedly on 14.07.2020 by claiming the deduction under section 80P of the Act. In this connection, section 80AC of the Act amended by the Finance Act, 2018, w.e.f. 01.04.2018 is extracted below:
“Deduction not to be allowed unless return furnished. 80AC. Where in computing the total income of an assessee of any previous year relevant to the assessment year commencing on or after— (i) the 1st day of April, 2006 but before the 1st day of April, 2018, any deduction is admissible under section 80-IA or section 80-IAB or section 80-IB or section 80-IC or section 80-ID or section 80-IE; (ii) the 1st day of April, 2018, any deduction is admissible under any provision of this Chapter under the heading "C.—Deductions in respect of certain incomes", no such deduction shall be allowed to him unless he furnishes a return of his income for such assessment year on or before the due date specified under sub-section (1) of section 139.”
From the plain reading of the section 80AC of the Act as referred above, it is clear that any deductions claimed under this Chapter under the heading "C.—Deductions in respect of certain incomes", no deduction shall be allowed unless the assessee files return of income for such assessment year on or before the due date specified under section 139(1) of the Act. Section 80AC of the Act limits its allowability of deduction under this Chapter in respect of certain incomes specifically for the return of income furnished on or before the due date specified under section 139(1) of the Act and not for the return of income furnished under any other section of the Act.
Under similar circumstances the Hon’ble High Court of Madras in the case of AA520 Veerappampalayam Primary Agricultural Co-operative Credit Society Ltd., Vs. DCIT (supra) relied on by Ld DR held in Para 8 as follows:
“8. The provisions of section 80AC(ii) make it clear that any deduction that is claimed under Part C of Chapter VIA would be admissible only if the return of income in that case were filed within the prescribed due date. Thus no claim under any of the provisions of Part C of Chapter VIA would be admissible in the case of a belated return. There is no dispute on this position. The date of filing of a return of income would be apparent on the face of return and upon a perusal thereof, it would be clear as to whether the return is a valid return, having been filed within the statutory time limit, or a belated one. This is mechanical exercise and one that can be carried out by the CPC, very much within the scope of section 143(1)(a)(ii) of the Act.”
It cannot be given an interpretation to cover the return of income filed belatedly beyond the time limit specified under section 139(1) of the Act. We are therefore inclined to dismiss the appeal.
In the result, appeal of the assessee is dismissed.
