What did the High Court hold?

The High Court upheld the ITAT's decision, finding that the respondent, Trichur Urban Development Authority, was entitled to exemption under Explanation (iii) to Section 10(20) of the Income Tax Act. The Court agreed with the Tribunal's finding that the respondent was controlled by the Municipal Corporation and was eventually merged with the Trichur Municipal Corporation. Furthermore, the Court acknowledged the Tribunal's observation that the respondent functioned similarly to a municipality even before its merger. The appeal filed by the Commissioner of Income Tax was consequently dismissed. The operative direction was the dismissal of the appeal.

What were the facts?

The appeal was filed by the Commissioner of Income Tax, Trichur, against an order of the Income Tax Appellate Tribunal (ITAT), Cochin Bench. The respondent is the Trichur Urban Development Authority. The core issue revolves around the respondent's claim for exemption under Section 10(20) of the Income Tax Act. The ITAT had previously ruled in favor of the respondent, finding that it was controlled by the Municipal Corporation and eventually merged with the Trichur Municipal Corporation. The Tribunal also noted that the respondent functioned similarly to a municipality even before its merger.

What were the issues?

1. Whether the respondent, Trichur Urban Development Authority, is entitled to exemption under Section 10(20) of the Income Tax Act, 1961, based on its control by and merger with the Trichur Municipal Corporation. Assessee's Contentions: The respondent (Trichur Urban Development Authority) contended that it was controlled by the Municipal Corporation and subsequently merged with it. It also argued that its functioning was similar to that of a municipality prior to the merger, thus qualifying for exemption under Explanation (iii) to Section 10(20). Revenue's Contentions: The revenue (Commissioner of Income Tax) challenged the ITAT's order granting exemption. The judgment does not explicitly record the revenue's specific arguments beyond their appeal against the ITAT's decision.

I.T. Appeal No.461 of 2009 .................................................................... Dated this the 13th day of July, 2009.

JUDGMENT Ramachandran Nair, J. The question raised pertains to respondent's claim of exemption under Section 10(20) of the Income Tax Act. We have heard Senior Standing Counsel appearing for the appellant and have gone through the Tribunal's order. The Tribunal has given a finding that the respondent was controlled by the Municipal Corporation and ultimately was merged with the Trichur Municipal Corporation. In fact even prior to it's merger with the Trichur Municipal Corporation, it was functioning very similar to that of the Municipality. We are of the view that the Tribunal has rightly held that the respondent is entitled to 2 exemption under Explanation (iii) to Section 10(20) of the Income Tax Act. The appeal is accordingly dismissed. C.N.RAMACHANDRAN NAIR Judge C.K.ABDUL REHIM Judge pms
