THE CATHOLIC SYRIAN BANK LTD. vs. ASSISTANT COMMISSIONER OF INCOME TAX
What did the High Court hold?
The High Court held that the valuation of unquoted Government security is in favour of the assessee, referencing its judgment in ITA No. 234 of 2009. Regarding disallowance under Section 14A, the Court held that assessments completed could not be revised for such disallowance for any period prior to 2001-2002, citing its decision in ITA No. 720/2009. For the issue of addition in block assessment under Section 115JA, the Court directed the assessing officer to consider the application of clause (f) of Section 115JA and make the assessment accordingly. The appeals were allowed in part, reversing the Tribunal's orders where they were against these decisions, and the assessing officer was directed to modify the assessments.
What were the facts?
The appeals were filed by The Catholic Syrian Bank Ltd. against the Assistant Commissioner of Income Tax. The assessment years are not explicitly stated but the appeals concern orders passed by the Income Tax Appellate Tribunal, Cochin Bench. The appeals were heard together. The High Court of Kerala referred to its previous judgments in ITA No. 234 of 2009 and ITA No. 720/2009, and also noted a direction given to the assessing officer regarding block assessment. The core of the dispute revolves around the valuation of unquoted Government securities, disallowance under Section 14A, and additions in block assessment under Section 115JA.
What were the issues?
1. Whether the valuation of unquoted Government security is to be determined in favour of the assessee. (Question of law) 2. Whether assessments completed could be revised for disallowance under Section 14A for periods prior to the assessment year 2001-2002. (Question of law) 3. Whether an addition in block assessment under Section 115JA is valid, and if so, whether clause (f) of Section 115JA should be considered. (Question of mixed law and fact) Assessee's Contentions: The assessee likely contended that the valuation of unquoted Government security should be in their favour. They would also argue against the disallowance under Section 14A for periods prior to 2001-2002. Regarding Section 115JA, they would seek consideration of clause (f) for assessment. Revenue's Contentions: The revenue likely argued for a different valuation of unquoted Government securities. They would support the disallowance under Section 14A. For Section 115JA, their stance would be to uphold the addition made.
