What did the High Court hold?

The High Court held that the Tribunal was correct in allowing a deduction for expenses related to the incentive bonus earned by the assessee, a Development Officer from LIC. However, the deduction is limited to the extent of reimbursement of actual expenses incurred, capped at a maximum of 30% of the incentive bonus earned. The Court answered the referred question in the affirmative, in favour of the assessee and against the Revenue, based on its reasoning in a prior, similar judgment dated 27.04.1998 in ITR No. 54/93 and cognate matters. The operative direction is to allow the deduction up to 30% of the incentive bonus earned, representing actual expenses incurred.

What were the facts?

The Income Tax Appellate Tribunal (ITAT) referred a question to the High Court of Gujarat concerning the assessment year 1988-89. The assessee, S.H. Radia, a Development Officer with the Life Insurance Corporation (LIC), claimed a deduction of 40% of incentive bonus towards expenses incurred in earning that bonus. The Revenue challenged this claim. The High Court was asked to decide whether the ITAT was correct in its ruling. The case was heard along with other similar matters.

What were the issues?

1. Whether the Appellate Tribunal is right in law and on facts in holding that the assessee was entitled to claim deduction of 40% of the incentive bonus towards expenses in earning the said bonus? (Question of law and fact, concerning the deductibility of expenses related to incentive bonus). Assessee's Contention: The assessee argued for a deduction of 40% of the incentive bonus towards expenses. The judgment does not explicitly record the assessee's arguments beyond this claim. Revenue's Contention: The Revenue challenged the assessee's claim for the 40% deduction. The judgment does not explicitly record the Revenue's specific arguments or any authorities relied upon.

ORAL JUDGEMENT (per R.K. Abichandani, J)

The Income Tax Appellate Tribunal has referred the following question which pertains for the assessment year 1988-89, for the opinion of this Court under Section 256(1) of the Income Tax Act.:

"Whether, the Appellate Tribunal is right in law and on facts in holding that the assessee was entitled to claim deduction to 40% of the incentive bonus towards expenses in earning the saind bonus?"

Identical question came up for our consideration in ITR No.54/93 and other cognate matters with which the entire group was argued and for the reasons given by us in our judgement dated 27.4.1998, we hold that the Tribunal was right in holding that the assessee was entitled for deduction of the incentive bonus as expenses out of the amount of incentive bonus received by the assessee - Development Officer from the Life Insurance Corporation, but only to the extent of reimbursement of expenses actually incurred upto the maximum limit of 30 per cent of the incentive bonus earned by the assessee. The question referred to us is accordingly answered in the affirmative against the Revenue and in favour of the assessee. 00000
