What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue. The Court noted that an identical matter, ITA No.16 of 2010, CIT v. Fateh Singh (HUF), had been decided on 15.7.2010 against the Revenue by the same Court. While the specific reasoning of the ITAT on the issues of bonafide belief regarding enhanced compensation and the necessity of proving contumacious intent for penalty is not detailed in the High Court's order, the dismissal of the appeal implies that the High Court found no substantial question of law arising or that the ITAT's decision was in line with its previous ruling on a similar matter. The operative direction was the dismissal of the appeal.

What were the facts?

The Revenue, Commissioner of Income Tax, filed an appeal under Section 260-A of the Income Tax Act, 1961, against an order dated 5.10.2007 passed by the Income Tax Appellate Tribunal (ITAT), New Delhi. The appeal pertains to Assessment Year 2001-02 and concerns the taxability of enhanced compensation and the levy of penalty. The ITAT's order was challenged by the Revenue, which sought to raise substantial questions of law. The High Court noted that an identical matter, ITA No.16 of 2010, CIT v. Fateh Singh (HUF), had been decided on 15.7.2010 against the Revenue by the same Court.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the ITAT was correct in holding that the assessee's view regarding the non-taxability of enhanced compensation was bonafide, particularly in light of Section 45(5) of the Income Tax Act? 2. Whether the ITAT erred in holding that proving contumacious intent is essential for levying penalty, contrary to the provisions of a Civil Statute like the Income Tax Act, irrespective of guilty intention? 3. Whether the ITAT's order contravenes various judicial pronouncements, including Thirupathy Kumar Khemka Vs. Commissioner of Income Tax? Assessee's Contentions: Not recorded in the judgment. Revenue's Contentions: The Revenue argued that the ITAT erred in its findings on the bonafide nature of the assessee's view on enhanced compensation and in requiring proof of contumacious intent for penalty imposition. The Revenue also contended that the ITAT's order was in contravention of judicial pronouncements.

Which sections of the Income-tax Act were involved?

This appeal has been preferred by the revenue under Section 260-A of the Income Tax Act, 1961 (for short, “the Act”) against the order dated 5.10.2007 of the Income Tax Appellate Tribunal, New Delhi in I.T.A. No.3294/Del/2006 for the assessment year 2001-02 proposing to raise following substantial questions of law:- “a. Whether on the facts and circumstances of the case, the Hon’ble ITAT was right in holding that the view of assessee regarding non taxability of enhanced compensation was bonafide particularly in view of provisions of section 45(5) of Income Tax Act? b. That the Hon’ble ITAT erred in deciding that proving contumacious intent is an essential ingredient in levy of penalty in contravention of the provisions of a Civil Statute like Income Tax Act in spite of there being so many judgments that breach of a Civil obligation attracts levy of penalty whether the contravention was made by the defaulter with any guilty intention or not?” c. That the order of the Hon’ble ITAT is in contravention Income Tax 210 CTR 287 (Mad)?”

Learned counsel for the revenue is unable to dispute that identical matter being I.T.A. No.16 of 2010 CIT v. Fateh Singh (HUF) has been decided on 15.7.2010 by this Court against the revenue. In view of above, this appeal is dismissed. (ADARSH KUMAR GOEL) JUDGE October 14, 2010 ( AJAY KUMAR MITTAL ) ashwani JUDGE 2
