What did the High Court hold?

The High Court noted that the parties agreed that similar matters for subsequent assessment years (2003-04 for the assessee and 2004-05 for a sister concern) had been adjudicated by the ITAT following the Supreme Court's judgment in Hero Exports v. Commissioner of Income Tax (2007) 295 ITR 454. These ITAT orders had become final. Given this, and the agreement of counsel, the High Court set aside the ITAT's order dated 15.5.2006 and remitted the matter back to the ITAT to pass fresh orders in accordance with the law, presumably considering the precedent established in the subsequent cases. The specific finding on the substantial question of law as originally framed was not directly addressed in the High Court's decision, as the matter was remitted.

What were the facts?

The revenue, Commissioner of Income Tax-III, Ludhiana, appealed to the High Court against an order dated 15.5.2006 passed by the Income Tax Appellate Tribunal (ITAT). The ITAT's order was in M.A. No. 341/Chandi/2005, arising from ITA No. 698/Chandi/2000, for the assessment year 1997-98. The assessee, M/s Nahar Spinning Mills Ltd., Ludhiana, derives income from manufacturing and exporting cotton yarn and woolen hosiery garments, and also trades in cotton yarn. The Assessing Officer (AO) assessed the income at Rs. 18,91,45,241/- against the returned income of Rs. 14,79,75,930/-. The assessee's appeal to the CIT(A) and then to the ITAT resulted in partial relief. The ITAT, in a subsequent order dated 15.5.2006, allowed the assessee's application to exclude 90% of gross interest from business profits for computing Section 80HHC deduction, reversing its earlier stance.

What were the issues?

1. Whether, on the facts and circumstances, the ITAT was legally correct in directing the AO to treat receipts of Rs. 7,99,88,954/- as per explanation (baa) of Section 80HHC for computing the deduction under Section 80HHC, despite the assessee having declared it as 'Income from Other Sources' and the AO assessing it under that head? Assessee's contention: The assessee argued that the interest income should be considered as part of business income for the purpose of calculating the deduction under Section 80HHC. The ITAT's order dated 15.5.2006, which allowed the exclusion of 90% of gross interest from business profits for Section 80HHC computation, was based on a subsequent clarification or understanding. The assessee relied on the ITAT's order which was later modified to allow this treatment. Revenue's contention: The revenue contended that the ITAT was wrong in directing the AO to treat the receipts as per explanation (baa) of Section 80HHC when the assessee itself had declared it as 'Income from Other Sources' and the AO had assessed it accordingly. The revenue challenged the ITAT's subsequent order which altered the treatment of this income for Section 80HHC purposes.

Which sections of the Income-tax Act were involved?

The assessee derives income from manufacture and export of cotton yarn woollen hosiery garments and also trades in cotton yarn. The assessee filed its return of income for the assessment year 1997-98 on 1.12.1997 declaring income at ` 14,79,75,930/-. The Assessing Officer vide order dated 18.1.2000 (Annexure A-1) framed the assessment at ` 18,91,45,241/-. Feeling aggrieved, the assessee filed an appeal before the Commissioner of Income Tax (Appeals) who vide order dated 9.6.2000 (Annexure A-2) partly allowed the appeal. Not feeling satisfied, the assessee filed an appeal before the Tribunal. The Tribunal vide order dated 7.10.2005 (Annexure A-3) partly allowed the appeal. However, the claim of the assessee that interest income of ` 7,99,88,254/- be assessed as business income and computation of deduction under Section 80HHC of the Act be made accordingly was rejected. Against the said order dated 7.10.2005 (Annexure A-3), the assessee filed an application before the Tribunal who vide order dated 15.5.2006 (Annexure A-4) allowed the said application holding that the Assessing Officer should exclude 90% of the gross interest from the profits of the business for computation of deduction under Section 80HHC of the Act. Hence, the present appeal by the revenue.

Learned counsel for the parties are agreed that subsequent to the decision by the Tribunal for the assessment year in question, i.e. 1997-98, similar matter came up for consideration before the Tribunal in Singh Gurbachan 2014.05.07 14:29 I attest to the accuracy and integrity of this document High Court Chandigarh -3- the case of the assessee for the assessment year 2003-04 and in the case of sister concern M/s Nahar Exports Ltd., Ludhiana for the assessment year 2004-05, where the Tribunal following the judgment of the Hon'ble Apex Court in Hero Exports v. Commissioner of Income Tax (2007) 295 ITR 454 had adjudicated identical issue vide orders dated January 28, 2008, December 31, 2007, respectively. It was not disputed that the orders of the Tribunal referred to in para 4 above have become final as no further appeals have been carried against the same. It was, thus, prayed that order of the Tribunal dated 15.5.2006 be set aside and the matter be remitted to the Tribunal to pass fresh orders in accordance with law. Ordered accordingly.
