DEPUTY COMMISSIONER OF INCOME -TAX CENTRAL CIRCLE-1(1), AHMEDABAD, AHMEDABAD, GUJARAT vs. JHAVERI TRADING AND INVESTMENT PVT. LTD., AHMEDABAD, GUJARAT
In favour of the assessee: the Revenue's appeal was dismissed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal held that the present appeal of the Revenue falls within the purview of CBDT Instruction No. 9 of 2024. It was not disputed by the Revenue that the tax effect on the disputed addition was less than Rs. 60 lakhs. Therefore, in view of the cited CBDT circular and the provisions of Section 268A of the Income Tax Act, the Tribunal was of the view that the appeal deserved to be dismissed. The appeal was accordingly dismissed. However, the Tribunal noted that if, upon re-verification by the AO, it could be demonstrated that the tax effect was more, or if the Revenue's case fell within the exceptions provided in the Circular, the Department would be at liberty to approach the Tribunal for recall of this order within the prescribed time period. The operative direction was the dismissal of the appeal.
What were the facts?
The Revenue, represented by the DCIT, filed an appeal before the Income Tax Appellate Tribunal (ITAT), Ahmedabad Bench 'B', challenging the order of the CIT(A)-11, Ahmedabad, dated 24/02/2025. The appeal pertains to Assessment Year 2011-12. The assessee, Jhaveri Trading and Investment Pvt. Ltd., argued that the tax effect on the disputed additions was below Rs. 60 lakhs. Consequently, they contended that the appeal should be dismissed based on CBDT Circular No. 9 of 2024, which instructs the Department not to file appeals before the Tribunal when the tax effect is below Rs. 60 lakhs. The Departmental Representative (DR) did not dispute the tax effect or the applicability of the circular.
What were the issues?
1. Whether the Revenue's appeal is maintainable before the Tribunal, considering the tax effect on the disputed additions is below Rs. 60 lakhs, as per CBDT Circular No. 9 of 2024? (Question of law) Assessee's Contention: The assessee argued that the appeal should be dismissed at the threshold as the tax effect on the disputed total additions is below Rs. 60 lakhs. They relied on CBDT Circular No. 9 of 2024, which is applicable to pending cases, instructing the Department not to file appeals before the Tribunal in such circumstances. Revenue's Contention: The Departmental Representative (DR) did not dispute the applicability of the CBDT circular or the fact that the tax effect was below Rs. 60 lakhs. He left the issue to the Tribunal to pass an appropriate order.

IT(SS)A No.46/Ahd/2025 DCIT vs. Jhaveri Trading & Investment Pvt.Ltd. AY: 2011-12
Before going to the merit of the case, the Authorized Representative (AR) for the assessee, at the outset, submitted that tax effect on the disputed total additions is below Rs.60 lakhs, therefore, by virtue of recent CBDT Circular No. 9 of 2024 dated 17.9.2024, Department has been instructed not to file appeal before the Tribunal, where tax effect is below Rs.60 lakhs. This instruction is applicable to the pending cases also. Therefore, the present appeal of the Revenue is liable to be dismissed at the threshold. Per contra, the Departmental Representative (DR) did not dispute applicability of the recent CBDT circular and also tax effect being below Rs.60 lakhs in the assessee case. He, however, left the issue to the Tribunal to pass appropriate order in the matter.
After hearing both the sides and after perusal of the above CBDT Instruction, we are of the view that the present appeal of the Revenue falls within the purview of the CBDT Instruction cited (supra). It is not disputed by the Revenue that tax effect on the disputed addition is less than Rs.60 lakhs, and therefore, keeping in view the above CBDT circular and provisions of section 268A of the Income Tax Act, we are of the view that the present appeal of the Revenue deserves to be dismissed. It is accordingly dismissed. However, it is noted that in case on re-verification at the end of the AO, if it can be demonstrated that the tax effect is more, or Revenue’s case falls within the ambit of exceptions provided in the Circular, then the Department will be at liberty to approach the Tribunal for recall of this order. Such application should be filed within the time period prescribed in the Act. In view of the above, the appeal of the Revenue is dismissed due to low tax effect.
