The Tribunal found that the CIT(Appeals) had considered the actual rent received and directed the AO to compute the rental income after accounting for vacant periods. Therefore, the order of the CIT(Appeals) was confirmed.
The Tribunal condoned the delay in filing the appeal before the CIT(Appeals) as there was a valid reason. The Tribunal also found that the CIT(Appeals) had not adjudicated the issue on merits in light of the evidence filed by the assessee.
The Tribunal, after examining the CIT(Appeals) order, found no infirmity and rejected the appeal. The assessee failed to appear for the hearing.
