The Tribunal held that Circular No. 21/2015, which sets a monetary limit for filing appeals, was applicable in this case. Since the tax effect was below the prescribed limit, the appeal was dismissed.
The Tribunal held that the lower authorities were not justified in relying on the statement of Shri V. Samba Moorthy without providing an opportunity for cross-examination to the assessee. The assessee had produced sufficient records to prove it was doing contract work and could rely on Section 44AD of the Act.
The tribunal observed that the assessee was not interested in prosecuting the case due to non-appearance. Therefore, the appeal was dismissed.
