XAVIER UNIVERSITY,PIPILI vs. ITO(EEXEMPTIONS), BHUBANESWAR
In favour of the assessee: the assessee's appeal was allowed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal held that since the assessee already had registration under Section 12AA, proving the genuineness of its activities, the requirement to produce physical books and vouchers for 80G recognition was not necessary. Therefore, the denial of 80G recognition was set aside.
What were the facts?
The assessee, Xavier University, was denied recognition under Section 80G(5)(vi) by the CIT(Exemptions) because it failed to produce books of account and vouchers. The assessee argued that for 80G recognition, only the charitable nature of objects matters, not income application, especially since it already had 12AA registration.
What were the issues?
Whether the CIT(Exemptions) was justified in denying 80G recognition solely on the grounds of non-production of books of account and vouchers, when the assessee already possessed 12AA registration.
Which sections of the Income-tax Act were involved?
