: 88 : ORDER
The above batch of writ petitions are filed seeking a direction to the respondents, who are the competent authorities, to renew the excise license issued in their favour styled as CL-7.
I have heard the learned counsel for the petitioners and also the learned Additional Government Advocate.
There is no dispute that the 1st petitioner is a registered association by name and style “The Karnataka State Tourism Hotel Owners Association(registered)” and all the members, who are running the hotels, at various places across State of Karnataka are also made as parties to this proceedings. It is also not in dispute that totally 1030 hotels are being run by them at different places across the Karnataka State. The 1st petitioner, having its registered office at Nehru Nagar, Belagavi, has taken the responsibility of protecting the common cause of all its members. Therefore, the present petitions appear to have been filed. The petitioners have taken up various
: 89 : grounds with regard to renewal of their license in the writ petitions. However, all those grounds are not necessarily to be considered by this Court.
There is no dispute that all the petitioners have been granted with CL-7 license for the purpose of vending liquor in their hotels. It is also not in dispute by the Government that each of the petitioner’s hotel is having more than 20/30 rooms as contemplated under Rule 3 sub rule (7) of the Karnataka Excise(Sale of Indian and Foreign Liquors) Rules, 1968(hereinafter referred to as ‘the Rules’ for brevity). It is also not in dispute that they have been running the hotels in the premises which falls within 500 meters or 220 meters as fixed by the Apex Court in a recent decision rendered by the Hon’ble Supreme Court in Civil Appeal No.12164-12166 of 2016.
The grounds urged by the petitioners is that Rule 5 of the Karnataka Exercise Licences(General Conditions) Rules 1967 which only restricts vending of liquor in a liquor shop or premises, within the distance of 100 metres from any religious or educational institution
: 90 : or Hospitals or any office of the State Government or Central Government or local authorities or in a residential locality where the inhabitants are predominantly belonging to Scheduled Castes and Scheduled Tribes or within a distance of 220 metres and 500 metres from the middle of the State Highways or National Highways respectively. It is submitted by the learned counsel that the said Rules have not been amended by the State Government and the petitioners’ licensed premises are within the said parameters.
Secondly, the learned counsel contended that the petitioners are the hoteliers and they are coming under the provisions of Rule 3 sub clause(7) of the Rules 1968 and it is further contended that according to the said provisions, they are vending or providing liquor only to their customers or to the guests as specifically mentioned in the said provision and the licence.
It is further contended by the learned counsel that the petitioners are having permanent buildings which are having 20/30 rooms, as per the Rules, and
: 91 : they cannot shift their premises anywhere. Further it is contended that they are not actually vending or selling the liquor to any other persons except to their guest and casual visitors and to their customers only and in the above said circumstances, he requests this Court to hold that the decision of the Apex Court is not applicable so far as the petitioners are concerned and direct the concerned authorities for renewal of their licence.
The learned Additional Government Advocate strenuously contends before this Court that the above said aspect ought to have been canvassed in detail before the Hon’ble Apex Court when an opportunity was given. Of course, the Apex Court has not considered anything about the Rule 3 sub rule(7) of the Rules. Therefore, if at all any clarification is required, the petitioners have to approach the Apex Court and when a matter is seized off by the Apex Court, this Court cannot give any such relief which will have adverse effect in the entire State.
Having heard the above said arguments and perusal of the decision of the Hon’ble Supreme Court, it is
: 92 : seen that the Apex Court in a recent decision in Civil Appeal No.12164-12166 of 2016 and other connected appeals, has laid down certain principles or guidelines with references to the issuance of licence to the liquor shops and liquor vendors. The said decision is mainly aimed at controlling the accidents on the State Highways and as well on the National Highways and to avoid drivers of the vehicles passing through State Highway and National Highways, consuming alcohol and in a drunken state of affairs drive the vehicle which is a root cause for the accidents.
Taking into consideration the above said laudable object, the Apex Court has specifically observed at paragraph 22 which reads as follows: “ 22. For all these reasons, we have come to the conclusion that no licences for liquor shops should be allowed both on the national and state highways. Moreover, in order to ensure that this provision is not defeated by the adoption of subterfuge, it would be necessary to direct that no exception can be carved out for the grant of liquor licences in respect of those stretches of the
: 93 : national or state highways which pass through the limits of any municipality corporation, city, town or local authority. Necessary safeguards must be introduced to ensure that liquor vends are not visible or directly accessible from the highway within a stipulated distance of 500 meters from the outer edge of the highway, or from a service lane along the highway.” (emphasis supplied)
Having come to such a conclusion, the Apex Court has also laid down certain guidelines at paragraph 24 which reads as follows: (i) All states and union territories shall forthwith cease and desist from granting licences for the sale of liquor along national and state highways; (ii) The prohibition contained in (i) above shall extend to and include stretches of such highways which fall within the limits of a municipal corporation, city, town or local authority; (iii) The existing licences which have already been renewed prior to the date of this order shall continue until the term of the licence expires but no later than 1 April 2017.
: 94 : (iv) All signages and advertisements of the availability of liquor shall be prohibited and existing ones removed forthwith both on national and state highways; (v) No shop for the sale of liquor shall be(i) visible from a national or state highway; (ii) directly accessible from a national or state highway and (iii) situated within a distance of 500 metres of the outer edge of the national or state highway or of a service lane along the highway. (vi) All States and Union territories are mandated to strictly enforce the above directions. The Chief Secretaries and Directors General of Police shall within one month chalk out a plan for enforcement in consultation with the state revenue and home departments. Responsibility shall be assigned inter alia to District Collectors and Superintendents of Police and other competent authorities. Compliance shall be strictly monitored by calling for fortnightly reports on action taken. (vii) These directions issue under Article 142 of the Constitution.
Subsequently, the Supreme Court, again moved by some aggrieved parties with some interlocutory
: 95 : applications, vide orders dated 31.03.2017 has clarified again with regard to the distances as mentioned in its earlier order at paragraph 22 and has observed that “ After considering the submissions which have been urged before this Court, we are of the view that there are three areas where the rigors of the directions which have been issued by this Court may require to be suitably modulated without affecting the basic principles underlying the judgment. The first is in relation to limits of local bodies with a population of less than 20,000 people. In such areas, it has been urged before this Court that a state highway is the main thoroughfare area along which the township has developed in small clusters of 20,000 or less. Hence, the requirement of maintaining the distance of 500 meters from the outer edge of the highway or service lane may result in a situation where the entire local area may fall within the prohibited distance. We find some substance in the submission. We must emphatically clarify that even in such areas falling under local bodies with a population of less than 20,000, no licence for the sale of liquor should be issued along either a national or state highway or a service lane along the highway. Similarly, the sale of liquor should be from a point which is neither visible from a national or state highway or which is directly
: 96 : accessible from a national or state highway. However, in such a situation, the prohibited distance should in our view be restricted to 220 metres form the outer edge of the national or state highway or of a service lane along the highway. We accordingly direct that the following paragraph shall be inserted, after direction (v) in paragraph 24 of the operative directions of this Court in the judgment dated 15th December 2016 namely: “In the case of areas comprised in local bodies with a population of 20,000/- people or less, the distance of 500 metres shall stand reduced to 220 metres.”
In view of the above said clarification, the Apex Court has only clarified with regard to the distance to be maintained from the edge of the roads, if the population is 20,000/- or less, distance of 500 metes has been reduced to 220 meters. Except that, no other modification has been made to the earlier decision rendered by the Apex Court.
In view of the above said decision, the learned counsel strenuously contends before this Court that the Apex Court has only directed the liquor shops which vend liquor along the side of National Highway or State
: 97 : Highway. The petitioners are not the liquor shops but they are the hoteliers and they are running the hotels for the purpose of promoting the Tourism Development as approved by the Government of Karnataka, therefore the rigor of the Apex Court is not applicable to the petitioners.
What is evident from the above said decision of the Apex Court is that the contesting respondents have not brought to the notice of the Apex Court with regard to Rule 3 sub rule (7) of the Rules as to whether the above said directions of the Apex Court is also applicable to the hotels who only vend the liquor to their guests/residents in the hotel rooms and as well as to their customers. It is worth to extract the said Rule which reads thus: “(7) Hotel and Boarding House Licences.-
(a) A licence under this clause shall be applied for and obtained in Form CL-7 from the Deputy Commissioner.
(b) No liquor under this licence shall be sold to persons other than those accommodated in the licenced hotel and boarding houses and their guests and
: 98 : casual visitors who take meals in such places. (emphasis supplied)
In consonance with the above provisions, CL- 7 licences were issued to the petitioners. The learned counsel also drawn my attention to Form No.CL-7 as per Annexure-Q wherein condition No.7 states that “the sale of liquor is restricted to the residents for their-own use and that of their guests requiring liquor with the meals supplied to them”. But no where it is explained, who are all the customers, so far as these hotels are concerned whether customers are already registered or any body/public can have access to those hotels etc. Further added to that what is prohibited in the Apex Court ruling is sale of liquor. Whether the supply of liquor by the Hoteliers to the customers and others amounts to sale of liquor is also another important point that needs to be considered or clarified in this regard.
Under the above said facts and circumstances of the case and on careful perusal of the
: 99 : decision of the Apex Court, these two important aspects have not been raised and considered by the Apex Court. Under the above said circumstances, when the matter is seized off by the Apex Court in Civil Appeal No.12169 of 2016 which is still pending and it is proposed to be posted on 04.07.2017, in my opinion, this Court should not give any opinion with regard to the above said substantial question of law i.e., with reference to the interpretation of Rule 3 sub clause(7) of the Rules and as well as the conditions of the licences and whether the hotels also can be equated with that of liquor shops which vend liquor. These points have to be clarified by the Apex Court itself by moving the Court by the petitioners. The petitioners can only approach the Hon’ble Apex Court for clarification or for interpretation of the above said provisions of law with reference to their licences. Therefore, writ petitions deserve to be dismissed. Accordingly, dismissed as this Court cannot grant any remedy as prayed by the petitioners.
: 100 : 17. In view of the above said facts and circumstances of the case, after dismissal of the petitions, the learned counsel for the petitioners requested this Court to grant certificate for Special Leave to approach the Apex Court directly without exhausting the remedy of filing a writ appeal in view of the urgency. He draws my attention to the decision of the Apex Court reported in AIR 2012 Supreme Court 3038 between Columbia Sportswear Company v. Director of Income Tax, Bangalore, wherein the Apex Court has observed as follows: “the Court can grant special leave when substantial question of general importance or similar question is already pending before the Supreme Court for decision”.
In this particular case, as the petitioners have been running the hotels all over the State of Karnataka, therefore, it is having a general importance. The interpretation of Rule 3 sub clause (7) and the conditions in the licence and as well as the interpretation of words “sale of liquor” in Rule 3(7) play a dominant role whether such license can be granted or continued so far
: 101 : as the hoteliers are concerned though their premises are within the prescribed limit of 500 meters or 220 meters as prescribed by the Apex Court. Under the above said circumstances, I do not find any strong reasons to refuse to issue certificate for special leave.
Under the above said circumstances, the following order is passed:
Writ Petitions are dismissed. No relief can be granted by this Court as prayed for. However, in view of the involvement of substantial question of general importance and interpretation of Rule 3(7) of the said Rule, as noted in the body of this order, certificate for special lave to Supreme Court requires to be granted.
Accordingly, office is hereby directed to issue certificate for special leave to the petitioners in Form No.3 of Schedule A of the Karnataka High Court Rules, 1959.
