THE COMMISSIONER OF INCOME TAX vs. M/S BPL SANYO TECHNOLOGY LTD
What did the High Court hold?
The High Court dismissed the review petition, stating that the matter could not be kept pending. However, they granted the Revenue liberty to seek a review if the Apex Court overturns the earlier judgment on which the dismissal was based.
What were the facts?
The Revenue sought a review of a High Court order that dismissed their appeal due to a low tax effect. They also argued that the appeal should await a decision from the Apex Court regarding the retrospective nature of Instruction No. 3/2011.
What were the issues?
Whether the review petition should be kept pending awaiting a higher court's decision, and if the Revenue has grounds for review based on a pending appeal.
