THE COMMISSIONER OF INCOME-TAX vs. M/S ITTIUM SYSTEMS PVT LTD.,
What did the High Court hold?
The High Court dismissed the review petition. However, it granted liberty to the Revenue to seek a review of the order if the Apex Court sets aside the previous judgment and holds the instruction as prospective.
What were the facts?
The Revenue sought a review of a High Court order that dismissed their appeal. The dismissal was based on the net tax effect being below the threshold, following a previous judgment. The Revenue also argued that an appeal against the retrospective nature of an instruction was pending before the Apex Court.
What were the issues?
Whether the High Court order dismissing the appeal due to low tax effect should be reviewed, and the impact of a pending Apex Court decision on a related matter.
Which sections of the Income-tax Act were involved?
