NAROTTAM SINGH TANWAR,PITHAMPUR vs. THE NFAC, DELHI
What did the Tribunal hold?
The Tribunal held that employee contributions paid after the due dates under PF/ESI laws but within the time allowed under Section 43B (i.e., by the due date for filing the return of income) are allowable as a deduction. The amendments made by the Finance Act, 2021, were held to be prospective and not applicable to the assessment years in question.
What were the facts?
The assessee made delayed payments of employee contributions to Provident Fund (PF) and Employees' State Insurance (ESI). The Assessing Officer (AO) made disallowances under Section 36(1)(va) of the Income Tax Act, which were upheld by the Commissioner of Income-Tax (Appeals).
What were the issues?
The primary issue was whether delayed payments of employee contributions to PF/ESI, made after the statutory due dates but before the due date for filing the income tax return, are allowable as a deduction. The applicability of the Finance Act, 2021 amendments was also a key consideration.
Which sections of the Income-tax Act were involved?
