NARASIMHA CHARY, J.M: Aggrieved by the order dated 08/11/2023 passed by the learned Commissioner of Income Tax (Appeals) - National Faceless Appeal Centre (NFAC), Delhi (“Ld. CIT(A)”), in the case of Aadarsh Global Trades & Services Private Limited (“the assessee”) for the assessment year 2018-19, assessee preferred this appeal. 2. At the outset, the Ld.AR submitted that this is the appeal against the penalty confirmed by the Ld.CIT(A), but the quantum appeal is still pending before the Ld.CIT(A), therefore, in the fitness of things, this matter
may also be restored to the file of the Ld.CIT(A) by setting aside the impugned order, because, it would be convenient for the Ld.CIT(A) to take a view in penalty also in consonance with the result in the quantum appeal. 3. Ld.DR reports no objection. 4. Recording the same, impugned order is set aside and the penalty appeal is restored to the file of the Ld.CIT(A) to decide along with the quantum appeal. Grounds are answered accordingly for statistical purpose. 5. In the result, appeal of the assessee is treated as allowed for statistical purposes. Order pronounced in the open court on this the 27th day of August, 2024.
