This appeal by assessee is arising out of order of CIT, Kolkata-III, Kolkata vide No. CIT-III/dc(Hq)-3/Kol/263/2012-13/8857 dated 30.01.2013/25.03.2013. Assessment was framed by DCIT, Circle-8, Kolkata u/s. 143(3) of the Income Tax Act, 1961 for AY 2008- 09 vide his order dated 31.12.2010.

At the outset, the Ld. Counsel for the assessee stated that he wants to withdraw this appeal filed by assessee as he has been received instruction from the assessee. Ld. DR has not objected to this prayer of the assessee. Accordingly, we permit the withdrawal and dismiss the appeal of assessee as withdrawn. 3.
