At the time of hearing before us, Shri Kanchun Kaushal, learned Advocate appeared on behalf of the assessee and requested for withdrawal of all the above five appeals filed by the assessee. He also filed a letter dated 27th December, 2016 to this effect. He stated that the assessee is in the process of applying for Dispute Resolution Scheme, 2016 to settle its disputes in this year and also other years. He, however, has requested that the assessee may be granted the right to revive the appeals if there is no fair and equitable settlement

2 ITA-5468/D/2011 & others under the Dispute Resolution Scheme, 2016 or if the assessee’s application under Dispute Resolution Scheme is rejected, withdrawn or cancelled.

Learned CIT-DR Shri Ravi Jain has no objection to the withdrawal of the above appeals by the assessee.

After considering the submissions of both the sides, we permit the assessee to withdraw these appeals. In case the petitioner’s application under the Dispute Resolution Scheme, 2016 is rejected in whole or in part, the petitioner shall be at liberty to take appropriate steps in the matter. With the above remark, the appeals of the assessee are dismissed as withdrawn.

In the result, all the five appeals of the assessee are dismissed as withdrawn. Decision pronounced in the open Court on 03.01.2017.
