Income Tax Appellate Tribunal, “D” BENCH: KOLKATA

This appeal by the Assessee is directed against the order of the Commissioner of Income Tax (Appeals), 1, Kolkata dt. 09-01-2017 for the A.Y 2012-13.
At the time of hearing before us Shri Abishek Bansal, ACA, the ld. AR of the assessee, submits that the assessee intends to withdraw the appeal by an application dt. 19-03-2018 (copy of the same is on record) as under:-
“ Sub: 2012-13- request for withdrawal of appeal We filed the aforesaid appeal on 20th Feb, 2017 against the order u/s. 263 of the Act passed by the Principal CIT, Kolkata-1, Kolkata, for which the aforesaid appeal number was given. We withdraw the aforesaid appeal filed by us which may be allowed. For this act of kindness we as in duty bound shall ever pray. Yours faithfully, For Day Night Securities Private Limited Sd/- Director”
In view of above, he urged to permit the assessee to withdraw the same. On the other hand, the ld.DR has not objected to such request of the ld.AR. In view of above, the appeal filed by the assessee is dismissed as withdrawn.
