AI SummaryDismissed

What did the Tribunal hold?

The Tribunal held that the assessee was eligible for deduction under Section 10A. The amendment to Section 10A in the Finance Act, 2000, extended the benefit to units set up under the Software Technology Park (STP) scheme, not just SEZs. The CIT(A)'s order was found to be without illegality.

What were the facts?

The assessee claimed deduction under Section 10A for income from its software development and export unit. The Assessing Officer disallowed this deduction, stating the unit was not set up in a Special Economic Zone (SEZ) as mandated. The CIT(A) allowed the deduction, leading to the Revenue's appeal.

What were the issues?

Whether a unit set up under the STP scheme, but not in an SEZ, is eligible for deduction under Section 10A. Interpretation of amendments to Section 10A concerning units set up after April 1, 2001.

Which sections of the Income-tax Act were involved?
