These three appeals by the assessee are directed against the order of Commissioner of Income Tax (Appeals)-4, Pune dated 30-06-2016 common for the assessment years 2009-10, 2010-11 and 2011-12.

Shri C.H. Naniwadekar appearing on behalf of the assessee has filed request letter dated 26-07-2018 from the assessee to withdraw the appeals.
Dr. Vivek Aggarwal representing the Department stated that the Revenue has no objection, if assessee wishes to withdraw the appeals.
Both sides heard. The assessee has filed letter dated 26-07-2018 to withdraw the appeals. The same is reproduced here-in-below : “Sub : Request for withdrawal of appeals in the case of Refcon Engineering Services Pvt. Ltd. Vs. DCIT [ITA No. 2238/PUN/2016 to ITA No. 2240/PUN/2016 for the A.Y. 2009-10 to A.Y. 2011-12] fixed on 27.07.2018 before Hon‟ble „B‟ Bench. The above appeals are fixed for hearing on 26.07.2018 before Hon‟ble „B‟ Bench. We would like to inform the bench that, we are not pressing the grounds of appeals. Hence we would like to withdraw our appeals. We would be very grateful if the above request is accepted. We are sorry for the inconvenience caused.”
In view of above request by the assessee, all the three appeals by the assessee are dismissed as withdrawn.
In the result, all the three appeals by the assessee are dismissed as withdrawn.
Order pronounced in open Court after hearing of the appeals on Thursday, the 26th day of July, 2018.
