What did the Tribunal hold?

The Tribunal observed that the assessee had failed to provide necessary details and explanations to both the CIT(A) and the Assessing Officer. Considering the counsel's request for a fresh opportunity, the Tribunal decided to remand the matter to the Assessing Officer for a de novo assessment. The assessee was directed to furnish all relevant documents, evidence, and bank details, and to comply with notices without seeking unnecessary adjournments.

What were the facts?

The assessee filed an appeal against an ex-parte order of the CIT(A) for AY 2017-18, which confirmed an addition of Rs. 94,93,350/- made under section 69A for cash deposited in the bank account. The assessee contended that the cash originated from its mobile recharge agency business, having been collected from distributors and paid to recharge providers, with commission already offered to tax. The CIT(A) upheld the addition due to the assessee's failure to furnish substantiating details despite multiple opportunities.

What were the issues?

Whether the NFAC erred in passing an ex-parte order without granting reasonable opportunity of hearing, and whether the addition under section 69A for unexplained cash deposits was justified given the assessee's claim of mobile recharge business income.

Which sections of the Income-tax Act were involved?

Section 69A
