A final opportunity was also granted on 05.09.2021 and 23.01.2024 to furnish details, clarifications and explanations to substantiate the source of the alleged unexplained cash deposits in various bank accounts under Section 68 of the Income-tax Jeetendra L Pate Vs. ITO Asst. Year : 2017-18 - 3– Act, 1961. However, despite being granted multiple opportunities, the assessee remained largely non-compliant and furnished submissions before the Ld. CIT(A) only on 15.02.2021. Consequently, the Ld. CIT(A), based on the material available on record, upheld the action of the Assessing Officer and dismissed the appeal ex parte. During the hearing before us, the Ld. Counsel submitted that due to the demise of the earlier Authorised Representative, the assessee could not effectively present his case or furnish the requisite documents before the Ld. CIT(A). The Ld.AR prayed that, given an opportunity, due compliance will be made and would furnish all the necessary details, clarifications and explanations before the revenue authorities. Considering the totality of the facts and in the interest of justice, we deem it appropriate to remand the matter to the file of the Ld.CIT(A) for conducting de novo adjudication. The assessee is directed to submit all relevant bank statements, documents and explanations before the Ld.CIT(A) and to strictly comply with the notices issued by the revenue authorities without seeking any unnecessary adjournments.
