JAMIA SLAFIA EDUCATIONAL SOCIETY vs. C.I.T.,
What did the Tribunal hold?
The Tribunal condoned the delay in filing the appeals due to justifiable cause. It also restored the appeals to the CIT for fresh adjudication, granting the assessee an opportunity to represent its case properly after assuring due compliance.
What were the facts?
The assessee filed appeals challenging the refusal of registration under sections 12AA and 80G. The appeals were filed late as the assessee claimed to have only become aware of the orders through an assessment order received much later. The assessee also claimed non-receipt of notices for hearings before the CIT.
What were the issues?
Whether the delay in filing appeals should be condoned and whether the assessee should be granted another opportunity to represent its case before the CIT for registration applications.
