Commissioner of Income Tax (Appeals)-2, Pune [hereinafter referred to as “the Ld. CIT(A)”] passed u/s 250 of the Income Tax Act, 1961
(hereinafter referred to as “the Act”) for AY 2019-20 dated 29.01.2024,

which has been passed against the intimation order u/s 143(1) of the Act, dated 22.07.2020. 2. At the time of the hearing before us, the assessee has submitted an application dated 19.12.2024 requesting to withdraw the present appeal as the appeal against the original return had already been adjudicated in the assessee’s favour. It is mentioned in the letter filed on 19.12.2024 that the present appeal was against the revised return and the appeal against the original return has already been adjudicated in favour of the assessee vide order dated 22/07/2024 in ITA No.
568/K01/2024 by the Hon’ble SMC Bench, Kolkata and therefore, the appeal No:- 1254/K01/2024 has become infructuous. The assessee has stated that it was withdrawing the Appeal No. ITA 1254/K01/2024. The ld. D/R had no objection in this regard.
3. In view of this, the appeal of the assessee in ITA No.
1254/KOL/2024 is accordingly dismissed as withdrawn as the same has become infructuous.
