What did the Tribunal hold?

The Tribunal noted that the earlier judgment concerning the adjoining property was crucial for a complete adjudication. Therefore, it directed both parties to provide the facts and taxability status of the compensation, solatium, and interest received for that adjoining property.

What were the facts?

The appeals concern the taxability of compensation, interest, and solatium received by the assessee from the compulsory acquisition of their property. Both parties relied on a Bombay High Court judgment from 2009, which in turn was based on an earlier judgment concerning an adjoining property.

What were the issues?

The primary issue is the correct tax treatment of compensation, interest, and solatium received from property acquisition. The Tribunal requires additional information regarding a similar case involving an adjoining property to ensure consistent and correct adjudication.

INTERIM ORDER During the course of argument undisputed fact has come on record that during compulsory acquisition of the property i.e. plot No.50 & 51 owned by the assessee, which is subject matter of the present appeals qua how to tax the compensation, interest and solcium received by the assessee, a judgment rendered by the Hon’ble Bombay High Court vide order dated 17.06.2009 in writ petition No.1855 of 2001 has been relied upon by both the parties to the appeal.
