What did the High Court hold?

The High Court held that while the assessee was a successor, he was not entitled to set off the firm's losses against his individual income under Section 170(1) and Section 78(2). However, due to the lack of clarity and misapprehension by the tax authorities regarding the applicability of Section 170, the penalty was not warranted.

What were the facts?

The assessee, who succeeded to a business from a dissolved firm, claimed set-off of the firm's losses against his individual income. This claim was rejected by tax authorities, and a penalty was imposed under Section 271(1)(c) for filing inaccurate particulars.

What were the issues?

Whether the penalty under Section 271(1)(c) was rightly imposed for claiming set-off of firm losses against individual income, considering the debatable nature of the issue due to the tax authorities' own misinterpretations.

Which sections of the Income-tax Act were involved?

Section 271(1)(c),Section 78(2),Section 170(1)
