PER MAHAVIR PRASAD, JUDICIAL MEMBER: The captioned appeal by the Assessee is directed against the order of the Principal Commissioner of Income Tax, Jamnagar (Pr.CIT) dated 28/03/2016.
The assessee seeks permission vide written representation to withdraw the captioned appeal of the assessee, since relief has been granted u/s.143(3) r.w.s. 263 of the Act and decided in favour of the assessee, for which Ld. Departmental Representative for the Revenue has not objected. Accordingly, we are allowing the prayer for
ITA No.158/RJT/2016 Darshana Piyush Vora vs. Pr.CIT Asst.Year – 2011-12 - 2 - withdrawal of appeal by the assessee. Thus, the appeal of the assessee has become infructuous.
In the result, the appeal of the assessee is dismissed as withdrawn. This Order pronounced in Open Court on 28/02/2019
