Learned counsel for the parties fairly stated that the controversy is covered by the decision rendered in ITA No. 100/2008 and 421/2010. A Division Bench of this Court by order dated 9.4.2010 has passed the following order in ITA No.421/2010: . . ?CM No. 3904/2010(Exemption) Allowed, subject to all just exceptions. . CM No. 3905/2010(Delay Application) For the reasons stated in the application as also on the basis of the submissions made by the counsel appearing on behalf of the appellant, the delay in re-filing the appeal is condoned. . ITA 834/2010 Page 1 of 2 ITA No. 421/2010 . The present appeal filed by the Revenue is directed against the Income Tax Appellate Tribunal?s order dated 27.3.2009 in ITA No. 4325/Del/2007 pertaining to the assessment order for the year 2002-03. The issues sought to be raised in the present appeal are virtually identical to the ones that have been the subject matter of the decision of this Court in the case of the very same assessee in ITA No. 381/2009 which was decided by a Division Bench of this Court on 5.11.2009. In view of the said decision, the present appeal deserves dismissal and it is ordered accordingly.? . . On a perusal of the aforesaid order, it is clear as crystal that the appeals were dismissed.
