What did the High Court hold?

The High Court noted that the petitioners had filed the writ petitions aggrieved by the refusal to grant interim protection. However, pending the adjudication of these writ petitions, the respondent authorities had already decided the appeals in favour of the petitioners. Furthermore, the department had also preferred an appeal before the Income Tax Appellate Tribunal, which was also decided in favour of the petitioners. Consequently, the Court found that no cause survived for further adjudication of the writ petitions. The petitions were accordingly disposed of as having become infructuous, with no order as to costs.

What were the facts?

This judgment concerns a batch of writ petitions filed by M/s. Suman Chit Funds Pvt. Ltd. and M/s. Neeladri Chit Fund Private Ltd. against the Income Tax Department. The petitioners challenged the refusal by the respondent income-tax authorities to grant a stay on the collection of demands raised under Sections 201(1)(b) and 201(1A) of the Income Tax Act, 1961, for assessment years 2005-06, 2006-07, and 2007-08. The demands, including tax and interest, amounted to significant sums, such as Rs. 1,40,85,307/- and Rs. 1,31,63,733/-. The petitioners sought a writ of mandamus to set aside these proceedings and direct the respondents not to collect the tax pending disposal of their appeals before the Commissioner of Income Tax (Appeals).

What were the issues?

1. Whether the action of the respondent income-tax authorities in refusing to grant a stay on the collection of demands raised under Sections 201(1)(b) and 201(1A) of the Income Tax Act, 1961, is illegal, arbitrary, and violative of the principles of natural justice and Articles 14 and 19(1)(g) of the Constitution of India, warranting a writ of mandamus. Assessee's contention: The petitioners argued that the refusal to grant a stay was contrary to the provisions of the Income Tax Act, 1961, and the Constitution, and sought to set aside the impugned proceedings and direct the respondent not to collect the tax pending appeal. Revenue's contention: The judgment does not explicitly record the revenue's contentions regarding the refusal to grant the stay. However, their participation as respondents implies opposition to the relief sought by the petitioners.

Which sections of the Income-tax Act were involved?

Section 201(1)(b),Section 201(1A),Section 156
