What did the High Court hold?

The High Court directed the second respondent, the Commissioner of Income Tax (Appeals), to decide the application for stay preferred by the petitioner within two months from the date of receipt of a copy of the judgment. The Court also ordered that until orders are passed on the stay application, further proceedings for realization of the amounts covered by the assessment order for 2015-16 shall be deferred. The High Court did not decide the merits of the appeal or the assessment orders themselves, focusing solely on the procedural aspect of the pending stay application.

What were the facts?

The petitioner, Quilandy Service Co-operative Bank Limited, is an assessee under the Income Tax Act. The petitioner is aggrieved by assessment orders for the assessment years 2014-15 and 2015-16, passed by the first respondent, the Income Tax Officer. The petitioner filed an appeal before the second respondent, the Commissioner of Income Tax (Appeals), and also an application for stay. Proceedings for realization of the amounts covered by the assessment order for 2015-16 have been initiated. The petitioner filed a writ petition seeking appropriate directions regarding these proceedings.

What were the issues?

1. Whether the High Court should issue directions regarding the pending appeal and stay application before the Commissioner of Income Tax (Appeals)? Assessee's Contention: The petitioner argued that realization proceedings have commenced for the disputed amounts while their appeal and stay application are pending before the appellate authority. They sought directions from the High Court to address this situation. Revenue's Contention: The judgment does not record any specific contentions made by the revenue. However, the revenue was represented by its Standing Counsel.

J U D G M E N T Petitioner is an assessee under the Income Tax Act (the Act) on the rolls of the first respondent.
