Ajaykumar Uppalapati vs. Income Tax Officer, Ward 15(1)
What did the High Court hold?
The High Court held that in light of its previous decision in Kankanala Ravindra Reddy v. Income Tax Officer, at this stage, after the remand by the appellate authority, the assessment ought to be carried out by the faceless assessment authority. This approach would align with the ratio laid down in the cited precedent. The court directed that the petitioner should raise this plea before the assessing authority upon appearance, after which the matter would be placed before the faceless assessment authority. The writ petition was disposed of accordingly, with no order as to costs. Any pending miscellaneous applications were also closed.
What were the facts?
The petitioner, Ajaykumar Uppalapati, filed a writ petition before the Telangana High Court challenging the actions of the Income Tax Officer (ITO), Ward 15(1), Hyderabad. The challenge was primarily against a notice under Section 148A(b) dated February 28, 2023, for Assessment Year (AY) 2016-2017, and subsequent proceedings including a notice under Section 148 dated March 25, 2023, an assessment order dated March 15, 2024, and a penalty order dated September 27, 2024. The petitioner argued that the jurisdictional assessing authority lacked the power to conduct the assessment after the implementation of the faceless assessment scheme. The matter had previously been remanded by the Commissioner of Income Tax (Appeals) to the assessing officer for a fresh assessment.
What were the issues?
1. Whether the jurisdictional assessing authority had the jurisdiction to undertake the assessment for AY 2016-2017 after the commencement of the faceless assessment scheme? Assessee's Contention: The petitioner argued that the jurisdictional assessing authority did not have the jurisdiction to conduct the assessment after the faceless assessment scheme came into force. They sought a direction for the assessment to be carried out by the faceless assessment authority. Revenue's Contention: The learned Senior Standing Counsel for the Income Tax Department submitted that the plea of jurisdiction was not raised before the appellate authority. However, the petitioner's counsel countered that the present writ petition was filed after the remand, and the court's ruling on the subject needed to be followed even after remand by the assessing authority.
