PRINCIPAL COMMISSIONER OF INCOME TAX-7 vs. SHRI P.MADHUSUDHAN REDDY
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The primary reasoning was based on the CBDT Circular No. 9 of 2024, which stipulated a monetary limit of Rs. 2.00 crore for filing appeals before the High Court. The Court found that the tax effect in the instant appeal was well below this prescribed limit. Therefore, the appeal was not maintainable under the revised guidelines. The Court also noted that if the appeal fell within any exceptions mentioned in Circular No. 5 of 2024, the Income Tax Department could seek revival of the appeal. No order as to costs was made.
What were the facts?
The Revenue, specifically the Principal Commissioner of Income Tax-7, Hyderabad, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 21.04.2017 passed by the Income Tax Appellate Tribunal, Hyderabad Bench-A. The appeal pertained to Assessment Year 2002-2003. The High Court noted that the Central Board of Direct Taxes (CBDT) had issued Circular No. 9 of 2024, amending Circular No. 5 of 2024, to enhance monetary limits for filing appeals. The revised monetary limit for filing an appeal before the High Court was Rs. 2.00 crore. The tax effect in the present appeal was stated to be well below this monetary limit.
What were the issues?
1. Whether the appeal filed by the Revenue is maintainable before the High Court given the monetary limits prescribed by the CBDT circulars? (Question of law) Assessee's Contention: The judgment does not record any specific contentions from the assessee. Revenue's Contention: The Revenue filed the appeal. The High Court's decision is based on the CBDT Circular No. 9 of 2024, which sets a monetary limit for filing appeals before the High Court. The tax effect in the present appeal is below this limit.
