What did the Tribunal hold?

The Tribunal held that the findings of the Ld. CIT(A) in paragraph 4.3.4 of the impugned order had become infructuous. This was due to a subsequent order dated 09.03.2026 passed by the Ld. CIT(Exemption), which granted registration under Section 12A(1)(ac)(i) for AY 2022-23 to AY 2026-27. The Tribunal reasoned that the assessee's claim for exemption deserved to be considered afresh in light of this new registration order. Consequently, the Tribunal set aside the impugned order and remanded the case back to the CPC to consider the assessee's case in view of the new registration order and pass a fresh intimation order under Section 143(1). The ratio decidendi is that a subsequent grant of registration under Section 12A, even if after the period under dispute, can validate prior claims for exemption if the delay in obtaining registration is condoned and the registration covers the period in question.

What were the facts?

The assessee, Shree Shankheshwar Parshwanath Jain Shwetambar Murti Pujak Sangh Trust, is challenging an order passed by the CIT(A) which upheld an intimation order under Section 143(1) of the Income Tax Act, 1961. The intimation order denied an exemption of Rs. 27,04,675 for Assessment Year (AY) 2023-24, stating that no registration under Section 12A had been granted. The assessee had claimed exemption under Section 11. The CIT(A) dismissed the assessee's first appeal, noting that the trust had failed to obtain fresh registration within the stipulated time as required by CBDT circulars and notifications, despite having an earlier registration under Section 12AA. The assessee's request for condonation of delay in filing Form 10A for registration under Section 12A(1)(ac)(i) was pending before the CIT(Exemption). The appeal before the ITAT pertains to AY 2023-24 and AY 2024-25.

What were the issues?

1. Whether the Ld. Commissioner of Income Tax (Appeals) [CIT(A)] erred in law and on facts in upholding the addition made in the intimation under Section 143(1) by the CPC, Bengaluru, without considering the submissions furnished by the appellant? - Assessee's contention: The CIT(A) failed to consider the submissions and the request to keep the appeal proceedings in abeyance until the disposal of the condonation request for the delay in filing the registration application under Section 12A. The assessee argued that the denial of exemption under Section 11 was not justified. - Revenue's contention: The revenue relied upon the impugned order passed by the CIT(A).

Which sections of the Income-tax Act were involved?

Section 11,Section 12,Section 12A,Section 12AA,Section 143(1),Section 250,Section 253

4 Observations, Finding and Conclusions

4.1 We have to decide the legality, validity and the proprietary of

the “Impugned Order” basis records of the case & the rival

submissions canvassed before us.

4.2 We have carefully perused the records of the case and have

heard the submissions.

upon examining the rival contentions of the Ld AR and the Ld DR

canvassed before us are of the considered opinion that findings

of Ld CIT(A) in the impugned order one para 4.3.4 has now

become infructuous in view of the order for registration

dated 9/3/2026 which applies to AY 2022-23 to AY 2026-27

Paper book page 14 to 15 hence the claim of the Assessee

deserves to be considered a fresh in light of this order of the
