ITO-5(1), INDORE vs. SARITA MISHRA, INDORE
In favour of the assessee: the Revenue's appeal was dismissed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal held that the appeal filed by the Revenue is not maintainable. The Tribunal noted that the CBDT Circular No. 9/2024 dated 17.09.2024 revised the monetary limit for filing appeals before the Tribunal to ₹60 lakhs. In the present case, the tax effect in dispute is ₹4,48,050/-, which is less than the prescribed limit of ₹60 lakhs. Therefore, as per the circular, the Revenue is not expected to pursue this appeal. Consequently, the Tribunal dismissed the appeal filed by the Revenue without considering the merits of the case. The Tribunal also clarified that the Revenue is at liberty to file a miscellaneous application if the case falls under an exception clause. The appeal was dismissed on the preliminary ground of the monetary limit prescribed by the CBDT.
What were the facts?
This appeal was filed by the Revenue against the order dated 04.02.2025 of the Commissioner of Income Tax (Appeals), National Faceless Appeal Centre, Delhi. The said order arose from an order dated 30.05.2023 passed by the Assessing Officer, NFAC, under Section 147 read with Section 144B of the Income Tax Act, 1961. The assessment year in question is 2015-16. The assessee is Sarita Verma, residing at 5 (1), 28, South Rajmohalla, Indore. The appeal was heard on 26.10.2026 and pronounced on 30.10.2026. The dispute pertains to the tax effect of the assessment.
What were the issues?
1. Whether the appeal filed by the Revenue is maintainable before the Tribunal, considering the monetary limit prescribed by the CBDT for filing appeals. The Revenue argued that the appeal should be decided on merits. The Assessee, through their counsel, drew the Tribunal's attention to the latest CBDT Circular No. 9/2024 dated 17.09.2024, which revised the monetary limit for filing appeals before the Tribunal to ₹60 lakhs. The Assessee contended that as per paragraph 4 of the said circular, no appeal should be filed by the department if the tax effect does not exceed ₹60 lakhs, subject to conditions under Section 268A of the Income Tax Act. Paragraph 5 of the circular states that these instructions will also apply to pending appeals, which should be withdrawn accordingly. The Assessee argued that the tax effect in the present appeal is below the prescribed limit and does not fall under any exception clause.
