What did the Tribunal hold?

The Tribunal allowed Ground No. 1 of the assessee, quashing the notice dated 20/06/2023 issued under Section 148 of the Act for Assessment Year 2019-2020 as being bad in law. The Tribunal found that the notice was issued after the expiry of the three-year period from the end of the relevant assessment year. Even after excluding the time granted to the assessee for responding to notices under Section 148A(b) and the seven days specified in the 6th Proviso to Section 149(1), the notice under Section 148 fell outside the three-year period. Consequently, the provisions of Section 149(1)(b) of the Act were applicable. As the income escaping assessment was only INR 1,00,000/-, which is below the INR 50 Lakhs threshold stipulated in Section 149(1)(b), the notice could not be sustained. The Assessment Order dated 27/01/2025 was also quashed as a consequence. All other grounds raised by the assessee were dismissed as having become academic and infructuous.

What were the facts?

The assessee, Shreyansh Navinbhai Shah, filed an appeal against the order of the National Faceless Appeal Centre (NFAC), Delhi. The NFAC had partly allowed the assessee's appeal against an assessment order passed under Section 147 read with Section 144B of the Income Tax Act, 1961, for Assessment Year 2019-2020. The original assessment order was dated 27/01/2025, and the NFAC's order was dated 23/12/2025. The primary issue revolved around the validity of reassessment proceedings initiated by the Assessing Officer (AO). The assessee contended that the notice under Section 148 of the Act was issued beyond the prescribed time limit.

What were the issues?

1. Whether the reassessment proceedings initiated under Section 147 of the Act are valid, considering the provisions of Section 149(1)(b) and Section 151 of the Act? Assessee's Contention: The assessee argued that the notice under Section 148 was issued on 20/06/2023, which was more than three years after the end of the relevant assessment year (31/03/2023). Therefore, Section 149(1)(b) of the Act was attracted. The assessee further contended that the requisite approval under Section 149(1)(b) read with Section 151 of the Act from the Principal Chief Commissioner of Income Tax was not obtained. Additionally, the amount of escaped income (INR 1,00,000/-) was below the threshold of INR 50 Lakhs specified in Section 149(1)(b), making the notice invalid. Revenue's Contention: The Revenue contended that the period granted to the assessee to file a reply to the notice issued under Section 148A(b) of the Act should be excluded while calculating the three-year period. This, according to the Revenue, would mean the three-year period did not expire on 31/03/2023.

Which sections of the Income-tax Act were involved?

Section 147,Section 144B,Section 148,Section 148A,Section 149,Section 151,Section 80GGC,Section 234A,Section 234B,Section 234C,Section 234D,Section 270A,Section 272A

The present appeal has been preferred by the Assessee against the Order, dated 23/12/2025, passed by National Faceless Appeal Centre (NFAC), Delhi [hereinafter referred to as the ‘CIT(A)’] whereby the Learned CIT(A) had partly allowedthe appeal against the Assessment Order, dated 27/01/2025, passed under Section 147 read with Section 144B of the Income Act, 1961 [hereinafter referred to as ‘the Act’] for the Assessment Year 2019-2020.

2.

The Assessee has raised following grounds of appeal: 1. The Ld. CIT(A) has erred, both in law and on facts, in confirming the action of Ld. AO in reopening the assessment under section 147 of the Act.

2.

The Ld. CIT(A) has erred, both in law and on facts, in confirming the disallowance of Rs.1,00,000/- made by Ld. AO under section 80GGC of the Act. 3. The Ld. CIT(A) has erred, both in law and on facts, in confirming the disallowance made under section 80GGC of the Act merely on the basis of general information and material without carrying out any independent inquiry in the case of the assessee. 4. The Ld. CIT(A) has erred, both in law and on facts, in not affording the assessee an opportunity of cross examination which grossly violates principles of natural justice. 5. Both, AO &CIT(A), have erred in passing the impugned orders without properly appreciating facts of the case, submissions of the assessee and documentary evidences. available on record in the correct perspective. Such an act is in gross violation of the principles of natural justice. 6. The Ld. CIT(A) has erred in law and on facts of the case in confirming levy of interest u/s. 234A/B/C/D of the Act. 7. The Ld. CIT(A) has erred in law and on facts of the case in confirming the action of initiation of penalty proceedings under section 270A of the Act. 8. The Ld. CIT(A) has erred in law and on facts of the case in confirming the action of initiation of penalty proceedings under section 272A(1)(d) of the Act. 3. We have head both the sides and have perused the material on record. We have also taken into consideration the synopsis/submission filed by the Assessee as well as the judgments relied upon during the course of hearing. We would first take up Ground No.1 raised by the Assessee challenging the validity of the reassessment proceedings.

4.

The relevant facts in brief are that for the Assessment Year 2019-2020 reassessment proceedings and notice under Section 148 of the Act was issued on 20/06/2023.

5.

According to the Assessee the period of 3 years from the end of the relevant assessment year expired on 31/03/2023. The notice under Section 148 of the Act was issued on 20/06/2023, after the expiry of the aforesaid period of 3 years from the end of relevant assessment year. Consequently, provisions contained in Section 149(1)(b) of the Act were attracted. It was contended on behalf of the Assessee that reassessment proceedings were bad in law since requisite approval under Section 149(1)(b) of the Act read with Section 151 of the Act was not taken from Principal Chief Commissioner of Income Tax. Even otherwise, the amount of income that is said to have escaped assessment was below the threshold limit of 50 Lacs specified in Section 149(1)(b) of the Act and therefore, no notice under Section 148 of the Act could have been issued after 31/03/2023 in the present case.

6.

Per contra, the Learned Departmental Representative submitted that the time given to the Assessee to file reply to notice issued under Section 148A(b) of the Act is to be excluded while determining the aforesaid period of 3 years. Therefore, it would be incurred to contended that the period of 3 years from the end of the relevant assessment year expired on 31/03/2023

7.

Perusal of record shows that 3 notices were issued under Section 148A(b) of the Act by the Assessing Officer on 31/03/2023, 18/04/2023 and 26/04/2023. The Assessee was granted (a) time till 18/04/2023 by way of notice, dated 31/03/2023, (b) thereafter, time till 23/04/2023 by notice, dated 18/04/2023, and (c) thereafter, time till 28/04/2023 by notice dated 26/04/2023 in terms of Section 148A(b) of the Act. Taking into consideration the 3 notices issued by the Assessing Officer under Section 148A(b) of the Act the Assessee was granted 25 days (18 days + 5 days + 2 days) to file response in terms of Section 148A(b) of the Act. We note that even if the aforesaid period [along with period of 7 days specified in 6th Proviso to Section 149(1) of the Act] is excluded, the notice under Section 148 of the Act issued on 20/06/2023 falls outside the period of 3 years of the relevant Assessment Year. Therefore, accepting the contention of the Assessee we hold that the provision of Section of 149(1)(b) of the Act would apply in the facts and circumstances of the present case. As per the applicable provisions contained in Section 149(1)(b) of the Act, reassessment proceedings could have been initiated only if the income escaping assessment was likely to be INR.50 Lakhs or more. Since in the present case the income escaping assessment was only INR.100,000/-, the notice issued under Section 148 of the Act could not be sustained in terms of Section 149(1)(b) of the Act. Accordingly, the notice, dated 20/06/2023, issued for the Assessment Year 2019- 2020 is quashed as being bad in law. Consequently, the Assessment Order, dated 27/01/2025, also stands quashed. Thus, Ground No. 1 raised by the Assessee is allowed. All the other grounds raised by the Assessee are dismissed as having been rendered academic and infructuous.

8.

In result, present appeal preferred by the Assessee is partly allowed.
