What did the Tribunal hold?

The Tribunal noted that the CIT(A) had granted hearing opportunities on 10.06.2025, 01.10.2025, and 12.11.2025, but these notices were sent to the wrong email address. Consequently, the assessee could not participate in the appellate proceedings, leading to an ex-parte order. Upholding the principle of natural justice, the Tribunal set aside the matter back to the file of the Ld. CIT(A). The Ld. CIT(A) was directed to provide one more opportunity of hearing to the assessee, ensuring notices are sent to the correct email address as per Form No. 35, and thereafter pass a fresh order on merits. The appeals were allowed for statistical purposes. The decision in ITA No. 67/JPR/2026 was deemed applicable to ITA No. 77/JPR/2026 due to similar issues and differing only in figures.

What were the facts?

The assessee, Shri Khatu Shyam Infra, a firm engaged in sub-contracting for railway over-bridge construction, filed appeals against orders of the CIT(A) NFAC, Delhi, for AY 2020-21 and 2019-20. These orders arose from reassessment proceedings initiated under Section 147 of the Income Tax Act, 1961. For AY 2020-21, following a search operation on associated groups, the Assessing Officer (AO) noted cash expenses of Rs. 55,43,092/-. Despite the assessee's claim of recording these in the cash book, the AO made a 15% disallowance of Rs. 8,31,464/- due to incomplete reconciliation, adding it to the total income. The CIT(A) passed an ex-parte order confirming the addition, citing non-compliance with hearing notices.

What were the issues?

1. Whether the initiation of assessment proceedings under Section 147 for AY 2020-21 was bad in law and facts for want of jurisdiction, against the principle of natural justice, and without proper approval, thus deserving to be quashed? 2. Whether the Assessing Officer erred in making a lump sum disallowance of Rs. 8,31,464/-, being 15% of total cash expenditure of Rs. 55,43,092/-, which is contrary to law, excessive, unjustified, and deserves complete deletion? Assessee's Contentions: - The assessee argued that it could not appear before the Ld. CIT(A) because hearing notices were sent to an incorrect email address (artage@hotmail.com) instead of the one mentioned in Form 35 (sksinfrajaipur@gmail.com), violating the principle of natural justice. - On merits, the assessee contended that it had furnished a comprehensive reconciliation of the Rs. 55,43,092/- expenditure, reconciling entries transaction-wise, date-wise, page-wise, or on an aggregate basis with regular books, thus the AO's ad-hoc 15% disallowance was incorrect and should be deleted. Revenue's Contentions: - The Revenue supported the orders passed by the lower authorities.

2.

Since the identical issues involved in both the appeals, therefore the same are disposed of by this common order.

3.

Firstly, we are dealing ITA No. 67/JPR/2026 (AY 2020-21) as the lead case. Brief facts of the case are that the assessee is a firm engaged in executing the construction of a railway over-bridge as a sub- contractor. For the AY 2020-21, the assessee filed its original return of income on 31.01.2021 declaring total income of Rs. 8,59,230/-. A search and seizure operation was carried out on the Kotahwala Group on 03.08.2022 and consequent search/survey action was carried out at various business and residential premises of the Aashish Group to which the assessee belongs. Thereafter, notice u/s. 148 was issued on 31.03.2024 and assessee filed the original return of income on 18.05.2024. Based on the seized materials and a list of expenses, the assessee has incurred expenses of Rs. 55,43,092/- in cash for project SKS Infra during the year under consideration. The assessee was specifically asked to explain the unaccounted expenses made in cash and also the source thereof. The assessee filed its reply stating that all expenses incurred in cash are duly recorded in cash book of the assessee, thereby requested not to make any addition. The AO held that the assessee was not able to reconcile the complete cash expenses on day to day basis as per list prepared from the documents found during the search proceedings. Therefore, the AO taking into account the nature of business, volume of business and in absence of complete reconciliation, made 15% disallowance of the total cash transaction i.e. Rs. 8,31,464/- and added to the total income of the assessee.

4.

Aggrieved against the reassessment order, the assessee filed the appeal before Ld. CIT(A) who passed an exparte order on the ground

I.T.A No. 67 & 77/JPR/2026 Page No 3 Shri Khatu Shyam Infra

that the assessee has failed to comply to the hearing notices and confirmed the addition made by the AO.

5.

Aggrieved against the appellate order, the Revenue is in appeal before us raising the following Grounds of Appeal:-

“Ground 1. Under the facts and circumstances, the initiation of assessment proceedings u/s 147 for AY 2020-21 is bad in law and facts for want of jurisdiction, being against the principle of natural justice and without proper approval, thus deserves to be quashed. Ground 2. Under the facts and circumstances, Ld. A.O. has erred in making lumpsum disallowance of Rs. 8,31,464/-, on account of being 15 percent of total cash expenditure of Rs. 55,43,092/-. The said action and resultant addition is contrary to the law as well as facts, excessive, unjustified and deserves a complete deletion.

Ground 3. Under the facts and circumstances, Ld. A.O. has erred in assessing total income at Rs. 16,90,690/-. The said action and resultant additions are contrary to the law as well as facts, excessive, and deserves a complete deletion.

Ground 4. That the appellant craves your indulgence to add, amend OR alter all OR any grounds of appeal before OR at the time of the hearing.”

6.

Ld. Counsel appearing for the assessee submitted that assessee could not appear before Ld. CIT(A) for the reason that communication of hearing notices as mentioned in Form No. 35 was sksinfrajaipur@gmail.com whereas the hearing notices were sent to artage@hotmail.com and copies of the screenshots are available at page no. 1 and 2 of the Paper Book. Thus, assessee could not appear before Ld. CIT(A) since the notices were sent to wrong email address. On merits of the case, Ld. Counsel submitted that assessee has furnished a comprehensive reconciliation of total expenditure of Rs. 55,43,092/- appearing in the impounded register. The entries contained in the daily site register stood reconciled either transaction

wise, date wise, page wise or on aggregate basis, depending upon the manner in which the underlying transactions were actually recorded in the regular books. Therefore, the AO was not correct in making adhoc disallowance @ 15% and requested to delete the addition.

7.

Per contra, Ld. DR appearing for the Revenue supported the orders passed by the lower authorities.

8.

Heard the rival submissions and perused the materials available on record including the Written Submission and Paper Book filed by the assessee. It is undisputed fact that Ld. CIT(A) has granted opportunities of hearing dated 10.06.2025, 01.10.2025 and 12.11.2025 as the same were sent to wrong email address and for this reason, the assessee could not participate in the appellate proceedings which resulted in passing exparte appellate order. Therefore, in the interest of Principle of Natural Justice, we deem it fit to set aside the matter back to the file of Ld. CIT(A) with a direction to give one more opportunity of hearing to the assessee by sending the notice to the email as mentioned in Form No. 35 and then pass fresh order on merits of the case.

9.

Resultantly, the appeal filed by the assessee is hereby allowed for statistical purposes.

ITA No. 77/JPR/2026 (AY-2019-20)

10.

Since there is no change in the facts except change in figure of addition, therefore the decision rendered in ITA No. 67/JPR/2026 is squarely applicable in this present appeal.

11.

In the combined result, both the appeals filed by the assessee are allowed for statistical purposes.
