What did the Tribunal hold?
The Tribunal held that the notice issued under Section 148 of the Act dated 26.07.2022 is invalid as it was issued beyond the permissible limitation period. The Tribunal noted that the first notice under the old regime was issued on 28.06.2021. As per the Supreme Court's order in Rajeev Bansal, the AO had 5 surviving days to issue a notice under the new regime, which expired on 30.06.2021. A notice under Section 148A(b) was issued on 31.05.2022, giving the assessee 14 days to reply, expiring on 14.06.2022. Adding the two surviving days, the financial date for issuing a new notice was 16.06.2022. However, the notice under Section 148 was issued on 26.07.2022, exceeding the limitation by over a month. Therefore, the notice dated 26.07.2022 was quashed, and consequently, all consequential proceedings were also quashed. The appeal was allowed on this legal issue.
