What did the High Court hold?

The High Court acknowledged that the appeal itself was pending before the Commissioner of Income Tax (Appeals). Recognizing that the interest of justice would be served by expediting the appellate process, the Court directed the Commissioner of Income Tax (Appeals) to decide the appeal of the petitioner within a period of three months from the date of receipt of a certified copy of the High Court's order. The Court did not delve into the merits of the recovery or the validity of the interim order, as the primary concern was the pending appeal. The operative direction was to expedite the disposal of the appeal.

What were the facts?

This Special Civil Application (SCA) was filed by Patel Alloy Steel (P) Ltd. The dispute concerned an amount recovered by the respondents (Commissioner of Income Tax-III and another) despite an interim order granted by the Commissioner of Income Tax (Appeals). The petitioner sought relief from the High Court of Gujarat. The procedural history indicates that an appeal was pending before the Commissioner of Income Tax (Appeals). The parties agreed that the appeal itself was pending, and the High Court was approached to address the recovery made in contravention of an interim order.

What were the issues?

1. Whether the respondents were justified in recovering an amount despite an interim order granted by the Commissioner of Income Tax (Appeals), a question of mixed law and fact concerning the enforceability of interim orders under the Income Tax Act, 1961. Assessee's Contention: The petitioner argued that the recovery was made in defiance of an interim order, implying a procedural impropriety or a violation of the stay granted by the appellate authority. Revenue's Contention: The judgment does not record any specific contentions from the revenue regarding the recovery or the interim order. The focus of the revenue's participation appears to have been on the pending appeal.
