What did the High Court hold?

The High Court dismissed the appeals filed by the Revenue on the grounds of low tax effect, as per CBDT Circular No.17/2019. The Court noted that the monetary limit for filing or pursuing appeals before the High Court had been increased to Rs.1 Crore, and the tax effect in these respective cases was below this threshold. Consequently, the appeals were dismissed without a decision on the merits of the substantial questions of law. The Court explicitly stated that the substantial questions of law framed were left open. Liberty was granted to the Revenue to seek restoration of the appeals if the tax effect was found to be above the threshold limit, to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, represented by the Principal Commissioner of Income Tax, Central II, Chennai, filed three appeals (TCA.Nos.990, 1007 & 1008 of 2019) before the High Court of Judicature at Madras. These appeals challenged a common order dated 24.12.2018 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'A' Bench, in ITA.Nos.1447, 1452 and 1445/Chny/2018. The appeals pertain to assessment years 2010-11, 2015-16, and 2009-10, respectively. The assessee is M/s. Jubilee Plot and Housing Pvt. Ltd., Chennai. The appeals were admitted on substantial questions of law.

What were the issues?

The High Court was to decide three substantial questions of law: 1. Whether the ITAT was legally correct in holding that the Assessing Officer cannot initiate proceedings under Section 153A of the Income Tax Act, 1961, when no incriminating material was found during a search operation under Section 132 of the Act. 2. Whether the ITAT correctly disregarded the decisions of the Kerala High Court in CIT v. St. Francis Clay Decor Tiles (385 ITR 624) and the Karnataka High Court in Canara Housing Development Co. V. DCIT (49 taxmann.com 98). 3. Whether the ITAT was correct in confirming the disallowance of land development expenses at 24.35% of the expenditure, based on its prior order in the assessee's own case for assessment years 2007-08 and 2008-09, against which the department had appealed. The Revenue argued that the appeals were not being pursued due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for appeals to the High Court to Rs.1 Crore. The tax effect in these cases was below this threshold. The judgment does not record specific arguments from the assessee on these issues.
