What did the High Court hold?

The High Court decided not to adjudicate the substantial questions of law due to subsequent developments. The Government of India enacted the Direct Tax Vivad Se Vishwas Act, 2020, for the resolution of disputed tax matters. The assessee had filed the requisite Forms 1 & 2 under Section 4 of this Act on 28.03.2021. In light of the assessee availing the benefit under the Vivad Se Vishwas Act, the Court found no useful purpose in keeping the appeal pending. The Tax Case Appeal was disposed of on the ground that the assessee had filed the necessary forms. The Department was directed to process the application at the earliest. The assessee was granted liberty to restore the appeal if the decision under the Vivad Se Vishwas Act was not in their favour. The substantial questions of law were left undecided.

What were the facts?

The assessee, M/s. Vijay Dairy & Farm Products (P) Ltd., filed an appeal before the High Court of Judicature at Madras against an order of the Income Tax Appellate Tribunal (ITAT), Madras “B” Bench, dated 01.05.2015. This order pertained to the Assessment Year 2004-05. The appeal was admitted on substantial questions of law. The dispute revolved around the allowability of deductions under Sections 80IA(iv)(d) and 80IB(3) of the Income Tax Act, 1961. The High Court was informed that the assessee had availed the benefit under the Direct Tax Vivad Se Vishwas Act, 2020, by filing the requisite Forms 1 & 2 on 28.03.2021.

What were the issues?

1. Whether the Tribunal was right in holding that the claim of deduction under Section 80IA(iv)(d) and Section 80IB(3) of the Income Tax Act, 1961, is not allowable? 2. Whether the Tribunal was right in law in holding that the claim under Section 80IA/80IB is not allowable because the assessee has not maintained separate books of accounts for the cold storage plant, and it is part and parcel of the milk processing unit? 3. Whether, in the facts and circumstances of the case, the learned Income Tax Appellate Tribunal was right in law in not allowing the assessee's appeal for the assessment year 2004-05 by holding that the appellant, as a small-scale industrial undertaking operating a cold storage plant, is eligible for full relief under Section 80IA(iv)(d) and 80IB(3) of the Income Tax Act, 1961? Assessee's Contentions: The judgment does not record specific contentions made by the assessee's counsel regarding the substantial questions of law. However, the framing of the questions implies the assessee argued for the allowability of deductions under Sections 80IA(iv)(d) and 80IB(3). Revenue's Contentions: The judgment does not record specific contentions made by the revenue's counsel regarding the substantial questions of law. However, the framing of the questions implies the revenue argued against the allowability of deductions under Sections 80IA(iv)(d) and 80IB(3).

Which sections of the Income-tax Act were involved?
