What did the High Court hold?

The High Court noted the submission by the Revenue that the main appeal before the Income Tax Appellate Tribunal had already been disposed of. In light of this subsequent development during the pendency of the Tax Case Appeal, the High Court held that the necessity to decide the substantial questions of law framed for consideration would not arise as the issues had become academic. Therefore, the appeal was closed. The Court left the substantial questions of law open to be agitated in any other proceedings if the respondent-assessee or any other assessee deems it appropriate. No costs were awarded. The operative direction was to close the appeal.

What were the facts?

The Commissioner of Income Tax, Chennai (Revenue) filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 07.02.2014 passed by the Income Tax Appellate Tribunal (Tribunal), Chennai 'B' Bench. The order was made in S.P.No.107/Mds/2013 in ITA.No.2353/Mds/2012 for the assessment year 2008-09. The appeal was admitted on 24.11.2015 on substantial questions of law concerning the Tribunal's power to extend a stay beyond 365 days, as stipulated in the Third Proviso to Section 254(2A) of the Act. During the pendency of this appeal before the High Court, the Revenue submitted that the main appeal before the Tribunal had already been disposed of.

What were the issues?

1. Whether, on the facts and in the circumstances of the case, the Tribunal was right in extending the stay beyond the period of 365 days which is contrary to the Third Proviso stated in Section 254(2A) of the Income Tax Act, 1961? 2. Is not the finding of the Tribunal bad by extending the stay for a further period of 90 days on 07.02.2014 which would in aggregate amount to in all 506 days which is contrary to the statutory provisions enunciated in Section 254(2A) Third Proviso? 3. Whether the Tribunal has power to grant stay beyond 365 days in aggregate especially when the Third Proviso to Section 254(2A) clearly indicates that if the appeal is not disposed of within the period allowed, then the order of stay shall stand vacated? Assessee's Contentions: Not recorded in the judgment. Revenue's Contentions: The Revenue argued that the Tribunal's extension of stay beyond 365 days was contrary to the Third Proviso of Section 254(2A) of the Income Tax Act, 1961. They contended that the aggregate period of stay, including the further 90 days granted, amounted to 506 days, which violated the statutory provision. The Revenue also questioned the Tribunal's power to grant stay beyond the stipulated period, especially when the proviso mandates vacation of stay if the appeal is not disposed of within the allowed time.
