What did the High Court hold?

The High Court noted that the assessee had filed a declaration/undertaking under the Vivad Se Vishwas Scheme on 20.11.2020 and was awaiting orders. In light of this subsequent event, the Court directed the Competent Authority to process the declarations under the Direct Tax Vivad Se Vishwas Act, 2020, and pass appropriate orders expeditiously. The assessee was granted liberty to restore the appeals if the ultimate decision on their declarations under Section 4 of the Vivad Se Vishwas Act was not in their favour. The Court stated that if such a prayer for restoration was made, the Registry should entertain it without requiring applications for condonation of delay. The substantial questions of law were left undecided.

What were the facts?

These appeals were filed by the assessee, Shri Hari Poddar & others, L/H & Husband of Smt. Prathiba Poddar, against the common order dated 22.10.2018 passed by the Income Tax Appellate Tribunal, Chennai. The appeals challenge the Tribunal's decision concerning assessment years 1998-99 and 1997-98. The assessee is appealing to the High Court under Section 260A of the Income Tax Act, 1961. The respondent is the Deputy Commissioner of Income Tax, Circle-1, Erode. The appeals were filed against the Tribunal's order which dealt with the validity of reassessment proceedings initiated by the Assessing Officer.

What were the issues?

The Tribunal had to decide two substantial questions of law: 1. Whether the Tribunal was correct in holding that the assessment order indicated twin reasons for reopening, and thus the Assessing Officer validly issued notice under Section 148 and initiated reassessment proceedings. 2. Whether the Tribunal was correct in holding that reassessment proceedings were valid, even though the sole reason for the Assessing Officer assuming jurisdiction to reopen was found to be non-existent. The assessee argued that the reassessment proceedings were invalid. The Revenue contended that the reassessment proceedings were valid. The judgment does not explicitly detail the specific arguments or authorities relied upon by either side regarding the substance of these issues, other than the fact that the assessee had filed a declaration under the Vivad Se Vishwas Scheme.
