COMMISSIONER OF INCOME TAX vs. M/S. BAGHMAR FINANCE LTD.,
What did the High Court hold?
The High Court dismissed the appeals filed by the Revenue on account of low tax effect, in light of CBDT Circular No.17/2019. The Court noted that the tax effect in the respective cases was less than the threshold limit of Rs.1 Crore for pursuing appeals before the High Court. Consequently, the substantial questions of law raised in the appeals were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit. No costs were awarded. The Tribunal's findings on the ownership of the asset, genuineness of the windmill transfer, and pro-rata allocation of cost were not adjudicated upon by the High Court.
What were the facts?
The Commissioner of Income Tax, Chennai (Revenue) filed two appeals (TCA.Nos.960 & 961/2015) before the High Court of Judicature at Madras against the common order dated 23.8.2013 passed by the Income Tax Appellate Tribunal, Chennai 'B' Bench. These appeals pertained to assessment years 2008-09 and 2009-10 and challenged the Tribunal's decision regarding M/s.Baghmar Finance Ltd. (assessee). The core dispute involved the assessee's claim for depreciation on windmills. The Revenue's appeals were admitted on 24.11.2015 on substantial questions of law.
What were the issues?
The High Court had to decide the following substantial questions of law: 1. Whether, in the facts and circumstances of the case, the Tribunal was right in holding that the assessee company was the owner of the asset and entitled to depreciation of Rs.77,71,276/- and Rs.15,81,179 respectively? 2. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the transfer of windmill to the assessee, by which, the assessee claimed ownership was a genuine transaction? 3. Whether, on the facts and circumstances of the case, the Tribunal was right in holding that the cost of one windmill had to be allocated on pro-rata basis out of total cost of Rs.81 Crores alleged incurred by M/s.Surana Industries Ltd.? The Revenue argued that the appeals were not being pursued due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for appeals to the High Court to Rs.1 Crore. The tax effect in these cases was stated to be below this threshold. The assessee's arguments are not recorded as the appeals were dismissed on the grounds of low tax effect.
