What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue on account of low tax effect, as per CBDT Circular No.17/2019. The Court noted that the Revenue was not pursuing the appeal because the tax effect was below the threshold limit of Rs.1 Crore. Consequently, the substantial questions of law framed were left open. The Revenue was granted liberty to mention the case for restoration if the tax effect was found to be above the threshold limit. No costs were awarded. The specific findings of the ITAT on the disallowance of interest and loss on consumer durables were not adjudicated upon by the High Court.

What were the facts?

The Revenue, Commissioner of Income Tax, Chennai, filed an appeal before the High Court of Judicature at Madras against an order dated 30.6.2011 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'D' Bench. The appeal pertained to assessment year 2004-05 and challenged the ITAT's upholding of the CIT(A)'s deletion of disallowance of interest on bank overdraft amounting to Rs.9,63,866/- for advances made to group concerns, and the disallowance of Rs.90,57,232/- being loss on consumer durable activity. The appeal was admitted on substantial questions of law. However, the Revenue later submitted that it was not pursuing the appeal due to low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for appeals to Rs.1 Crore.

What were the issues?

The High Court was to decide the following substantial questions of law: 1. Whether, on the facts and in the circumstances of the case, the Income Tax Appellate Tribunal was right in upholding the orders of the CIT(A), who deleted the disallowance of interest made on bank over draft of Rs.9,63,866/- for the advances made to group concerns? 2. Whether, on the facts and in the circumstances of the case, the Income Tax Appellate Tribunal was right in upholding the order of the CIT(A), who disallowed a sum of Rs.90,57,232/- being the loss on consumer durable activity especially when the assessee was following mercantile system of accounting? The Revenue argued that the ITAT erred in upholding the CIT(A)'s deletion of interest disallowance and the disallowance of loss on consumer durable activity. The judgment does not record specific arguments from the assessee.
