PRINCIPAL COMMISSIONER OF IN vs. M/S. VODAFONE MOBILE SERVICE
What did the High Court hold?
The High Court dismissed the appeal filed by the Revenue. The dismissal was based on the submission by the Revenue's counsel that the appeal was not being pursued due to a low tax effect, citing CBDT Circular No.17/2019 which raised the monetary threshold for appeals to the High Court to Rs.1 Crore. The Court noted that the tax effect in this case was below the prescribed limit. Consequently, the substantial questions of law raised by the Revenue were left open. The Court granted liberty to the Revenue to file a petition for restoration of the appeal if the tax effect was found to be above the threshold limit, allowing it to be heard and decided on merits. The operative direction was the dismissal of the appeal.
What were the facts?
The Revenue, specifically the Principal Commissioner of Income Tax, TDS Circle, Coimbatore, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated 23.11.2017 passed by the Income Tax Appellate Tribunal, Chennai ('the Tribunal'). The appeal pertained to the assessment year 2012-13 and challenged the Tribunal's decision regarding the taxability of roaming/interconnect charges. The Revenue's counsel informed the High Court that the appeal was not being pursued due to a low tax effect, citing CBDT Circular No.17/2019 which increased the monetary limit for appeals to the High Court to Rs.1 Crore. The tax effect in this case was stated to be below this threshold.
What were the issues?
The Tribunal was to decide three substantial questions of law: 1. Whether roaming/interconnect charges are liable to TDS under Section 194J of the Income Tax Act, 1961. 2. Whether the Apex Court held that no human intervention is required for connecting roaming calls, specifically in the case of M/s. Bharti Cellular Ltd. 3. Whether the Tribunal was correct in holding that no human intervention is required for roaming calls except for physical connectivity and initial configuration, when no conclusive opinion was given by a technical expert. The Revenue contended that the Tribunal erred in its findings on these issues. The judgment records that the Revenue's counsel submitted that the appeal was not being pursued due to low tax effect as per CBDT Circular No.17/2019. No specific arguments from the Revenue on the merits of the substantial questions of law were recorded in the judgment.
