PALLAVARAM KOTHANDARAMAN RA vs. THE ASSISTANT COMMISSIONER
What did the High Court hold?
The High Court decided not to adjudicate the substantial questions of law due to subsequent developments, specifically the enactment of the Direct Tax Vivad Se Vishwas Act, 2020. The Court noted that the assessee intended to avail the benefit of this scheme to resolve tax disputes. The Court directed the assessee to file Form No.I under the VVS Act not later than 21.12.2020. The competent authority was directed to process the application expeditiously, preferably within six weeks of filing. The appeals were disposed of with liberty to the assessee to seek restoration if the decision on their declaration under the VVS Act was not in their favour. The substantial questions of law were left open. The operative direction was to dispose of the appeals with liberty to restore.
What were the facts?
The assessee, Pallavaram Kothandaraman Ramesh, filed two appeals (T.C.A.Nos.914 and 916 of 2019) before the High Court of Judicature at Madras. These appeals challenged an order dated 29.08.2013 passed by the Income Tax Appellate Tribunal (ITAT), Chennai, in M.P.No.53/Mds/13 in I.T.A.No.1808/Mds/2011. The appeals pertained to the Assessment Year 2008-2009. The procedural history involved the ITAT's order being challenged before the High Court. The High Court noted that the assessee intended to avail the benefit of the Vivad Se Vishwas Scheme (VVS Scheme).
What were the issues?
The High Court was to decide two substantial questions of law: 1. Whether the order of the ITAT was perverse in law. 2. Whether, on the facts and evidence on record, the ITAT was right in rejecting the miscellaneous petition in terms of Section 254(2) of the Income Tax Act, 1961. The assessee's counsel, on instructions, submitted that the assessee intended to avail the benefit of the Vivad Se Vishwas Scheme and was taking steps to file the necessary declaration. The Revenue's contentions were not recorded as the matter was disposed of based on the assessee's intention to opt for the VVS Scheme.
