What did the High Court hold?

The High Court did not decide the substantial questions of law framed for consideration. The court was informed by the assessee's counsel that the assessee had opted for the Direct Tax Vivad Se Vishwas Act, 2020, and had been issued Form-3. Consequently, the assessee sought permission to withdraw the appeals. In view of this submission, the High Court dismissed the Tax Case Appeals as withdrawn. No costs were awarded. The specific findings or reasoning of the ITAT on the issues raised by the assessee are not detailed in this High Court judgment, as the appeals were disposed of on a procedural development.

What were the facts?

The assessee, M/s. Viswams, filed Tax Case Appeals (TCA) Nos. 904 and 905 of 2019 before the High Court of Judicature at Madras. These appeals challenged the order dated 28.08.2015 passed by the Income Tax Appellate Tribunal (ITAT), Chennai 'B' Bench, concerning assessment years 2006-07 and 2007-08. The appeals were admitted on substantial questions of law. During the pendency of the appeals, the Government of India enacted the Direct Tax Vivad Se Vishwas Act, 2020. The assessee informed the court that they had been issued Form-3 under this Act and sought permission to withdraw the appeals.

What were the issues?

The High Court was to decide substantial questions of law concerning the validity of assessments made under Sections 153A read with 153C of the Income Tax Act, 1961, in the absence of incriminating material discovered during a search. Additionally, the court was to consider whether the ITAT was correct in rejecting the assessee's consistent method of valuing closing stock at 'cost or realisable value whichever is less'. The questions also touched upon whether the ITAT erred in holding that the assessee changed its valuation method consequent to the search, despite returns being filed prior to the search with the same stock valuation. The assessee argued that the valuation method, which involved discounting purchase price based on stock age and realisability, was consistently followed and that no income escaped assessment as actual sale value is captured in the year of sale. The revenue's contentions are not explicitly recorded in the provided text.

Which sections of the Income-tax Act were involved?

Section 260A,Section 153A,Section 153C
