What did the High Court hold?

The High Court dismissed the Tax Case Appeal on account of low tax effect, as submitted by the Revenue. The Court noted that the Revenue was not pursuing the appeal based on CBDT Circular No. 17/2019, which sets a monetary threshold of Rs. 1 Crore for appeals to the High Court, and that the tax effect in this case was below that limit. The substantial question of law raised in the appeal was expressly left undecided. The Court granted liberty to the Revenue to file a petition for restoration if the tax effect is found to be above the threshold limit, allowing the appeal to be heard and decided on merits. No costs were awarded.

What were the facts?

The Revenue, specifically the Principal Commissioner of Income Tax, Corporate Circle 4(1), Chennai, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated April 28, 2017, passed by the Income Tax Appellate Tribunal, Chennai ('the Tribunal'). The appeal pertains to the assessment year 2011-12 and challenges the Tribunal's deletion of an addition made by the Revenue. The amount in dispute is not explicitly stated, but the appeal is being dismissed due to low tax effect.

What were the issues?

1. Whether, on the facts and circumstances of the case and in law, the Tribunal is correct in deleting the addition made under Section 2(24)(x) read with Section 36(1)(va) of the Income Tax Act, 1961? The Revenue argued that the appeal is not being pursued due to a low tax effect, citing CBDT Circular No. 17/2019 which increased the monetary limit for appeals before the High Court to Rs. 1 Crore. The Revenue stated that the tax effect in this case is below this threshold. The assessee's contentions are not recorded in the judgment.

Which sections of the Income-tax Act were involved?
